<br />t-j <"~ <br />~ ;J 1 <br />-.!~/~) <br /> <br />TUESDAY <br /> <br />JANUARY 23, 1968 <br /> <br />WHEREAS, under date of December 12, 1967, Martinsville City Council <br />initiated appropriate proceedings to so vacate and abandon said portion <br />of Salem Street under procedures set forth in Section 3 of Chapter 8 of <br />the City Charter, concluded by a duly-advertised public hearing having <br />been conducted by said COQDcil during its regular meeting held January <br />23, 1968, at which hearing no objections were registered by any citizen <br />to said proposed closing; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this 23rd day of January, 1968, that said <br />undeveloped portion of Salem Street, between Manilla Street and Memorial <br />Boulevard, be and is hereby vacated, abandoned, and closed, subject to <br />the retention by the City of Martinsville of existing utility right-of-way <br />easements within said portion and subject to the dividing of right-of-way <br />(being abandoned) by use of a straight line between Manilla Street and <br />Memorial Boulevard in such a manner as the abutting property owners will <br />receive an equal share thereof; and <br /> <br />BE IT FURTHER ORDAINED that a copy of this ordinance be forthwith filed <br />with the Clerk of the Corporation Court of the City of Martinsville, as <br />directive that his records be marked accordingly. <br /> <br />In connection with the petition filed with Council on November 14, 1967, by <br /> <br />the Roy C. Stone interests, requesting the rezoning from IIR_911 to IIR-611 of <br /> <br />that property identified as the IIWray Farmll on or near Roundabout Road, the <br /> <br />Planning Commission presented the following written report (dated January 22, <br /> <br />1968) which Council unanimously accepted, thus recording the fact that <br /> <br />petitioner has withdrawn his rezoning petition thereon: <br /> <br />The Martinsville City Planning Commission conducted a public hearing <br />on January 2, 1968, on a petition from Mr. Roy C. Stone requesting <br />the rezoning from R-9 to R-6 Residential, a portion of the Wray Farm <br />on Roundabout Road. At the time of this hearing the Commission <br />received a petition signed by forty-one residents in the immediate <br />area opposing this rezoning request. Mr. Stone then advised the <br />Commission that should this opposition not be withdrawn by the time <br />of the next Planning Commission meeting that he would withdraw his <br />petition for rezoning. <br /> <br />The Commission met again on January 18, 1968, at which time the <br />Commission was advised by the petitioners for the opposition that <br />their petition still stood and would not be withdrawn. Following <br />this advice from the opposition, Mr. Stone formally withdrew his <br />petition for rezoning. <br /> <br />The Planning Commission respectfully submits the above information <br />for Council's further consideration. <br />
