Upon motion, duly seconded and unanimously carried {of those members present), Council adopted an ordinance entitled, "AN 'ORDINANCE TV GRANT TO C. HARRY ANGLIN, T/A CLEAR-VIEW CABLE TELEVISIVN OOMPANY, THE RIGHT, FOR THE TERM AND UP.oN THE CDNDITIONS HEREIN STATED, TO USE THE STREETS, ALLEYS AND PUBLIC PLACES TO OONSTRUCT, INSTALL, OPERATE AND MAINTAIN A COMMUNITY ANTENNA TELEVISION SYSTEM, INCLUDING CDNDUITS AND APPURTENANCES, NECESSARY TO THE SALE AND DISTRIBUTION OF OOMMUNITY ANTENNA TELEVISI.oN SERVICE IN AND AL.oNG THE STREETS, ALLEYS AND .oTHER PUBLIC PLACES IN THE CITY OF MARTINSVILLE, VIRGINIA; ESTABLISHING CONDITIONS CONTR.oLLING THE SALE AND DISTRIBUTION OF COMMUNITY ANTENNA TELEVISION; AND REGULATING THE MANNER OF USING THE STREETS, ALLEYS AND PUBLIC WAYS", said ordinance being substantially the same as that adopted December 14, 1965, i.e., the ordinance inviting bids for the construction and operation of a CATV system in Martinsville under the terms and conditions therein set forth. &2id ordinance, granting the franchise, is to become effective May 1, 1966. After reviewing the bids received March 3, 1966, for the cost of constructing a portion of the Smith River Interceptor Sewer Line, as presented to Council on March 8, 1966, and after receiving a report and recommendation from the City's consulting engineers (Wiley & Wilson, Lynchburg, Virginia) as to "Division No.2", Council accepted the low bid(s) submitted by Prillaman & Pace (i.e., $244,464.00 for concrete pipe and/or $229,968.00 for metal pipe) with the understanding that--subject to discretion of and direction by the City--the contractor shall install whichever of the two types of pipe as, in the judgment of the City, conditions warrant and justify, thus enabling the City to take advantage of the less expensive pipe installation where advisable.
