31 TUESDAY MARCH 14, 1972 WHEREAS, the Department of Highways of the Commonwealth of Virginia has developed plans for the location and constructing of Brookdale Street within the corporate limits of the City of Martinsville; and WHEREAS, said plans have been reviewed with officials of the City of Martinsville; and WHEREAS, a location and design public hearing was held in Martinsville on February 9, 1972, for Brookdale Street; now, therefore, .- BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this fourteenth day of March, 1972, that it doth hereby endorse said plans and, furthermore, doth support the proceeding with the project (identified as Project U 000-120-101, PE-lOl, RW 201, C-50l) which extends from East Church Street (Route 58) to Spruce Street; and BE IT FURTHER RESOLVED that a copy of this resolution shall be filed with the Department of Highways of the Commonwealth of Virginia. WHEREAS, Section 33-57 of the CODE OF VIRGINIA (1950), as amended by the 1966 and 1968 sessions of the Virginia General Assembly, authorized the State Highway Commission to acquire rights-of-way for the construction, reconstruction, alteration, maintenance and repair of public highways within Virginia municipalities on projects which are constructed with State or Federal participation; and WHEREAS, said Section 33-57, as amended, further provides that the State Highway Commissioner may exercise such authority only upon receipt of an official request from the city or town involved; now, therefore, BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this fourteenth day of March, 1972, that it doth hereby request the State Highway Commissioner to acquire the necessary rights-of-way for Project U 000-120-101, PE-lOl, RW 201, C-50l, within the _corporate limits of the City of Martinsville and to convey titles to such rights-of-way to the City of Martinsville upon completion of the project; and BE IT FURTHER RESOLVED that the City of Martinsville agrees to reimburse the State Highway Department in the amount of fifteen percent (15%) of all costs incurred in the acquisition and conveyance of such rights-of-way and it is understood that such acquisitions will be handled by the Highway Commissioner under established policies and procedures and that his decision in these matters shall be final.
