<br />(U~ <br />'-.jU <br /> <br />TUESDAY NOVEMBER 23, 1971 <br /> <br />overlapping of fiscal years. Council referred this matter to the City <br /> <br />Manager and the City Attorney for study and recommendation. <br /> <br />Mr. Murvin L. Joyce, of Fieldale, Virginia, by letter requested water and <br /> <br />sewer service for his proposed car-wash facility to be located on the north <br /> <br />side of VC Drive at its intersection with Armory Road, all outside the <br /> <br />City's corporate limits and for which a water line extension would be <br /> <br />necessary. Council referred this request to the Planning Commission for <br /> <br />its consideration and recommendation and, also, for compliance requirements <br /> <br />as to lease arrangement and restrictive covenants, inasmuch as Mr. Joyce <br /> <br />stated in his request that he is not the owner of the property for which <br /> <br />service is being requested, having leased same from Lester Lumber Company, Inc. <br /> <br />Mr. D. D. Palmer, owner of certain property on the Old Dye Plant Road <br /> <br />formerly owned by the City, requested water and sewer service for this <br /> <br />location known as the "Old Incinerator", now being a warehouse. Upon being <br /> <br />informed that an extension of a six-inch water main from the rear of this <br /> <br />property could accomplish the request for water service, Council authorized <br /> <br />such service subject to preparation and execution of an appropriate contract <br /> <br />which would include necessary restrictive covenants. <br /> <br />Through City Attorney Cubine, Council was apprised of the fact that Northview <br /> <br />Gardens Associates, a partnership with which Council entered into an agreement <br /> <br />(dated July 12, 1971) by action taken July l3, 1971, which agreement sets forth <br /> <br />terms and conditions under which the City will make water and sewer service <br /> <br />available to this partnership's proposed apartment complex near or off Stultz <br /> <br />Road, desires to change--or has changed or is changing--its name to that of <br /> <br />"Northview Gardens Associates Limited Partnership" and, accordingly, wishes to <br /> <br />. ._,_.".".,~_".,,~."n"____""__""'__''''''''''~_'~~'~__'''''''_"''''''''-"-"'-~'-"'''--'~''-'-'- <br />
