<br />27 <br /> <br />TUESDAY <br />---- <br /> <br />OCTOBER 12, 1971 <br /> <br />WHEREAS, by petition filed with Martinsville City Council on June 8, 1971, <br />Mrs. Beulah W. Covington and Mrs. Nannie J. Draper requested the closing <br />and vacating of that portion of Douglas Street on which Lots Nos. l, 2, 3, <br />4, 8, 9, 10, and II front, which petition was subsequently amended to <br />apply only to Lots Nos. 8, 9, lO and ll, and (which) amended petition <br />included the requested rezoning of said Lots Nos. 8, 9, lO and II from <br />"R-6 Residential" to "C-3 Commercial"; and <br /> <br />WHEREAS, the Martinsville Planning Commission, to which agency said petition <br />was duly referred, having conducted a duly-advertised public hearing on same, <br />by report dated August l2, 1971, has recommended that the amended petition <br />be approved; and <br /> <br />WHEREAS, a duly-constituted Board of Viewers (appointed to consider said <br />amended petition as it pertained to the closing of said portion of Douglas <br />Street) has reported in writing that said portion of Douglas Street (i.e., <br />opposite Lots Nos. 8, 9, lO and ll) can be closed without inconvenience <br />to anyone; and <br /> <br />WHEREAS, at its regular meeting held September 28, 1971, Martinsvi11e City <br />Council conducted a duly-advertised public hearing on petitioners' amended <br />request, at which hearing no one registered any objections to the amended <br />proposal; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this twelfth day of October, 1971, that the portion <br />of Douglas Street, on which Lots Nos. 8, 9, 10, and ll, front be and is <br />hereby declared vacated, closed and abandoned, the effective date of which <br />shall coincide with the date on which petitioners submit a properly prepared <br />map suitable for recording--and the same is recorded--in the office of the <br />Clerk of Martinsville Corporation Court; and <br /> <br />BE IT FURTHER ORDAINED that the Zoning Code and the Zoning Map of the City <br />of Martinsville be--and is hereby amended--to reclassify to "C-3 Commercial" <br />zoning said Lots Nos. 8, 9, 10, and ll; and <br /> <br />,- <br /> <br />BE IT FURTHER ORDAINED that a copy of this ordinance be forthwith filed <br />with the Clerk of Martinsville Corporation Court as authorization to mark <br />his records accordingly. <br /> <br />Upon motion, duly seconded and unanimously carried, Council convened into an <br /> <br />Executive Session to consider a real estate matter. <br /> <br />- <br /> <br />2'~M<J'~____ <br />W.
