<br />- <br /> <br />.,- <br /> <br />') - <br /> <br />- <br /> <br />TUESDAY <br /> <br />AUGUST l7, 1971 <br /> <br />Pursuant to duly-advertised public notice, Council conducted a public hearing <br /> <br />on Mr. Victor A. Lester's May lIth petition requesting the rezoning of his <br /> <br />property lying between East Church Street and East Church Street Extended, <br /> <br />identified on plat dated May 3, 1971 as "Lot No. l" and "Lot No.2". Council <br /> <br />also reviewed the Planning Commission's report thereon, as submitted July 13, <br /> <br />1971, in which the Commission recommended that the requested rezoning (from <br /> <br />R-9 to P-2) of Lot No. 1 be approved but that the requested rezoning (from R-9 <br /> <br />to R-6) of Lot No. 2 be denied, suggesting that petitioner might obtain a <br /> <br />variance from the Board of Zoning Appeals as to Lot No.2 and, in this way, <br /> <br />the City would avoid "spot zoning" and petitioner's plans for usage of this <br /> <br />lot might be accommodated. Council then deferred action on that portion of <br /> <br />petition regarding said Lot No.2, pending a conference with the Planning <br /> <br />Commission thereon; however, upon motion, duly seconded and unanimously carried, <br /> <br />Council accepted the Commission's recommendation regarding Lot No.1, thereupon <br /> <br />adopting the following ordinance amending the City's Zoning Code and Map: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this seventeenth day of August, 1971, <br />that the Zoning Code and the Zoning Map of the City of Martinsville, <br />Virginia, be--and are hereby--amended to reclassify to "P-2 Professional" <br />that certain lot owned by Mr. Victor A. Lester and identified as "Lot No. <br />l" on Revision Plat (prepared by Marvin E. Scearce, C.L.S., under date <br />of May 3, 1971, and approved by Martinsville Planning Commission under <br />date of May 4, 1971), which lot fronts the south side of East Church <br />Street. <br /> <br />Also, pursuant to duly-advertised public notice, Council conducted a public <br /> <br />hearing on a petition filed May ll, 1971, by Mr. Earle W. Greene, Realtor, <br /> <br />Agent for Waldron & Fralin, Inc., requesting the rezoning of a 3~-acre tract <br /> <br />of land situated approximately 600 feet east of Brookdale Road, to the rear <br /> <br />of the Cooper & Ratcliff Store on Brookdale, said rezoning requested being <br /> <br />for "R-6 Residential" and said tract being a portion of a larger tract owned <br />
