<br />If -J <br /> <br />TUESDAY <br /> <br />JULY 14, 1970 <br /> <br />right of way line of present Bethel Lane from the northwest existing <br />right of way line of present Morgan Street opposite approximate <br />station 13+31 to a point on the lands of the landowners opposite <br />approximate station 14+09 and containing 1,190 square feet, more or <br />less land; together with the right and easement to use the additional <br />areas shown for cut and/or fill slopes as being required for the <br />proper execution and maintenance of the work, containing 1,830 square <br />feet, more or less. Said easement will terminate when the landowner <br />or assigned successors grades the property so that there no longer <br />exists cut and/or fill slopes, thus eliminating the necessity for <br />maintenance of said slopes. <br /> <br />Mrs. Lillie Sabb, of 115 Sellers Street, appeared before Council and appealed <br /> <br />for assistance in curbing the growth or destroying or replacing kudzu <br /> <br />encroaching upon her property from the rear lot line adjacent to Memorial <br /> <br />Boulevard, which type of vine was planted after the construction of Memorial <br /> <br />Boulevard for erosion control. Council referred this appeal to Public Works <br /> <br />Director George W. Brown, who estimated a cost of from $300.00-to-$400.00 to <br /> <br />provide a substitute and more controllable erosion control. <br /> <br />Council then considered a proposal recently submitted by Mr. J. B. Frith, of <br /> <br />Frith Construction Company, to exchange his 46.8-acre tract of land located <br /> <br />on Jones Creek for the City's 29.93-acre tract located on Smith River and the <br /> <br />Norfolk & Western Railway Company, the City1s tract having been originally <br /> <br />purchased as a site for the City's water pollution control plant and <br /> <br />identified as the "Hedgecock" property. Council then convened in Executive <br /> <br />Session, as permitted by State Statutes for the consideration of real estate <br /> <br />matters, to consider Mr. Frith's offer in the light of independent appraisals <br /> <br />obtained on these properties. Council then reconvened in and resumed its <br /> <br />regular session, followed by motion (duly seconded and unanimously carried) <br /> <br />whereby Council offered to exchange said properties for the consideration of <br /> <br />$24,000.00 to be paid by Mr. Frith's interests unto the City, thus authorizing <br /> <br />preparation of deeds of conveyance and the execution of same upon acceptance <br /> <br />by Mr. Frith of Council's offer. <br /> <br />"-" "'"'---'-''''""'~--"''''---'____~'_''",M'''"'''_''''_"_'_'''''"''~''"~..~.___,~,......_,__.._---.____"__"___ <br />
