<br />-J <br /> <br />TUESDAY <br /> <br />MAY 12, 1970 <br /> <br />Mr. Robert W. Grant, Executive Secretary of Henry County and Secretary of <br /> <br />the Henry County Public Service Authority, and Mr. W. Roscoe Reynolds, <br /> <br />Commonwealth's Attorney for the County of Henry, appeared before Council <br /> <br />and informed Council that a proposed contract drawn between the City of <br /> <br />Martinsville and the Henry County Public Service Authority, by which the <br /> <br />City would receive and treat sewage from the Villa Heights area (outside <br /> <br />the City's corporate limits), can not be executed by said Authority inas- <br /> <br />much as said Authority has no jurisdiction over certain requirements that <br /> <br />might be imposed, and, furthermore, such a contract should be with the <br /> <br />Henry County Board of Supervisors; however, in the absence of zoning and <br /> <br />subdivision regulations in the County of Henry and with no assurance that <br /> <br />such regulations would or could be adopted, the Henry County Board of <br /> <br />Supervisors also could not meet the zoning and subdivision requirements <br /> <br />set forth in said proposed contract. Council informed these representatives <br /> <br />of its sincere and continuing desire to cooperate in every way with these <br /> <br />agencies but that it could not forego or waive these requirements which <br /> <br />have been in force for a number of years and which have been incorporated <br /> <br />in all other agreements involving the furnishing of City utility services <br /> <br />to outside users. By resolution from the Public Service Authority's minutes <br /> <br />of April 20, 1970, the Authority requested "the City Council of Martinsville <br /> <br />to proceed as expeditiously as possible with the consumation of a <br /> <br />contractual agreement acceptable to both parties by not later than 25 May <br /> <br />1970" . <br /> <br />Henry County Commonwealth's Attorney W. Roscoe Reynolds also addressed Council <br /> <br />concerning the purchase option tendered the City on April 15th-16th by the <br /> <br />Daniel Creek Water Company, whereby--if the City chooses to exercise--the <br />
