<br />7 <br /> <br />TUESDAY <br /> <br />APRIL 14, 1970 <br /> <br />,---.. <br /> <br />WHEREAS, said Section 33-57 (as amended) further provides that the State <br />Highway Commissioner may exercise such authority only upon receipt of an <br />official request from the city or town involved; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, VirgLnia, in <br />regular meeting assembled this fourteenth day of April, 1970, that it doth <br />hereby request the State Highway Commissioner to acquire the necessary <br />rights of way for Project UOOO-120-l-l (RW-20l), further identified as <br />Brookdale Road project from East Church Street to Spruce Street, within <br />the corporate limits of the City of Martinsville, and to convey the title <br />to such rights of way to the City of Martinsville upon completion of said <br />project; and, further, <br /> <br />- <br /> <br />BE IT RESOLVED by said Martinsville City Council that it agrees to reimburse <br />the State Highway Department to the extent of fifteen percent (15%) of all <br />costs incurred in the acquisition and conveyance of such rights of way and <br />that it is understood that such acquisition will be handled by the <br />Commissioner under established policies and procedures and that his <br />decision in all instances shall be final. <br /> <br />Pursuant to terms of lease agreement with City Transit Company, Inc., and to <br /> <br />requirements of the Federal Government's Urban Mass Transportation Administration!s <br /> <br />grant contract pertaining to said agreement, which grant contract came into being <br /> <br />many months following the City's application for Mass Transportation funds, Council <br /> <br />unanimously approved the annual rental of $7,200.00 and ratified same retroactively, <br /> <br />i.e., to the initial date said rental was increased from $6,000.00 per year. <br /> <br />.............. <br /> <br />As executor of the Estate of Whitney Shumate, the Piedmont Trust Bank filed its <br /> <br />petition requesting the closing of a section of "E" Street, between Fifth Street <br /> <br />and Roundabout Road, which section is unopened and the property on both sides is <br /> <br />owned by petitioner, who desires to erect a home on property at the intersection <br /> <br />of said liE" Street and Fifth Street, now restricted by required corner setbacks. <br /> <br />Council referred this petition to both the Planning Commission and to a Board of <br /> <br />Viewers, the latter consisting of Messrs. William B. Muse, Leroy Perkins, and <br /> <br />Joseph W. Pritchett. <br />
