TUESDAY

FEBRUARY 24, 1970

on the proposal to rezone Lester Lumber Company's said strip of land,

-

Council accepted the following report and recommendation (dated February

24th) of the Planning Commission, thus authorizing the recommended joint

hearing by Council and the Commission to be conducted at Council's

forthcoming March 10th meeting on J. R. S. Enterprises' application for

a special-use permit under the unified development section of the City's

Zoning Ordinance (re: certain "C-l" uses in a residential zone) and,

-

also, effecting the recommended rezoning of the Lester Lumber Company

tract by the ordinance hereinafter following:

The Planning Commission, at its meeting on Thursday, February 19,
1970, gave further consideration to evidence heard at the public
hearing held jointly with Council on February 10th with regard to
J.R.S. Enterprises' request for special use permits and rezoning
certain property owned by Lester Lumber Company in north
Mart insvi lle .

Following much discussion of these two matters, the Commission voted
to recommend to Council that the 300' deep strip lying between the
8~ acre tract owned by J.R.S. Enterprises and Northside Drive and
extending from the entrance to the new hospital to the north line
of the J.R.S. Enterprises' property be rezoned from its present
R-9 Residential to a P-2 Professional classification.

The Commission felt that it should proceed with this rezoning
inasmuch as public hearing on this proposal was held jointly with
Council on February 10th and in view of the fact that there are
no plans for the use of this property in the immediate future.
That at such time as there are plans for usage of the property
the Commission would be most happy to give further consideration
to a request for rezoning to a Commercial classification.

With regard to the request for a special use permit by J.R.S.
Enterprises, the Commission voted to advertise a public hearing
to be held jointly with Council at its March 10th meeting on a
proposal to grant to J.R.S. Enterprises a special use permit under
the unified development section of the ordinance which would
allow certain C-l uses in a Residential zone.

The Planning Commission respectfully submits the above recommendation
for Council's further consideration.

fJ
