<br />J <br /> <br />TUESDAY <br /> <br />JANUARY 13, 1970 <br /> <br />.- <br /> <br />(2)i< Street. <br /> <br />For the purpose of this ordinance, a street shall <br />be construed to mean a public right-of-way which <br />affords the principal means of access to abutting <br />property, including avenue, place, way, drive, <br />lane, boulevard, highway, road and any other <br />thoroughfare, except an alley or private street. <br /> <br />(3)* Street, private. An access way which is not owned or maintained by <br />the public but which affords the principal access <br />to abutting properties. <br /> <br />( 4) ~'< Townhous e . <br /> <br />A dwelling unit for single family occupancy, <br />containing one or two stories, attached by one or <br />more vertical party walls extending to the roof <br />sheathing without openings of any king to any <br />other dwelling unit, each of which is served by its <br />individual exterior entrance door, and each of which <br />is designed and intended to be individually owned <br />along with the parcel of land which it occupies. <br /> <br />/- <br /> <br />- - - - - - - - - - - - - <br /> <br />--------- <br /> <br />~'<Legend: (1) Insert between "Clerk of the court" and "Dwelling". <br />(2) Revised by adding of "or private street". <br />(3) Insert between "Street" and "Street line". <br />(4) Insert between "Tourist home" and "Trailer". <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this thirteenth day of January, 1970, that <br />Sub-section "c" of Section VIII of the Zoning Ordinance of the City of <br />Martinsville be--and is hereby--amended to incorporate the following <br />sub-paragraph, as identified hereinbelow, under paragraph '.'1. Unified <br />developments", "a": <br /> <br />(7) The following criteria shall be used, in addition to the <br />foregoing cited requirements, in the consideration of any <br />application for a permit allowing townhouse or similar <br />developmen t: <br /> <br />(a) <br /> <br />Every developer of a townhouse project shall provide for, <br />to the satisfaction of the City Council, the establishment <br />of a responsible corporate entity which shall be obligated <br />and empowered to own, operate and maintain all common areas <br />and facilities, and to assess against and collect from the <br />owners of townhouse units the pro-rata cost of such <br />ownership and maintenance. <br />Maximum percentage of total area which may be subdivided <br />into lots ............... <br />Maximum dwelling unit density (per acre) <br /> <br />. . . . . . . <br /> <br />45% <br />10 <br /> <br />(b) <br /> <br />(c) <br />
