...--- a&1 ~48 TUESDAY DECEMBER 31, 1974 Notice is hereby given by the City of Martinsvi11e, Virginia, a municipal corporation organized and existing under the laws of the Commonwealth of Virginia, pursuant to Section 15.1-835 of the 1950 Code of Virginia, as amended, of a public hearing to be held on December 31, 1974 at 1:00 o'clock p.m. in the City Council Chambers on the second floor of the Martinsvi11e Municipal Building, West Church Street, Martinsville, Virginia, at which citizens shall have an opportunity to be heard to determine if the citizens of the City of Martinsville desire that the City of Martinsvi1le request the General Assembly to amend its Charter, as follows: 1. To amend paragraph (5) under Section 2 of Chapter 1 changing the interest rate charged on delinquent real estate from 6% to a percentum per annum prescribed by council, but in no event to exceed the maximum interest rate allowed by law. 2. To amend Section 2 under Chapter 2 so that members of Council shall be elected according to General Law and their terms shall commence on the first of July next following their election rather than upon the first of September. 3. To amend paragraph (a) under Section 5 of Chapter 2 so that the organizational meeting of council shall be held at 9:00 o'clock a.m. on the first day of July following a regular municipal election, rather than on the first day of September. 4. To amend Section 7 of Chapter 2 so that the term of office of the mayor shall expire upon June 30 of his second year in office rather than upon August 31 of said second year. 5. To amend Section 1 of Chapter 4 so that any judge of the Circuit Court of the City of Martinsvi1le receiving the salary provided for thereunder must be a resident of the City of Martinsville, and by deleting in their entirety the first paragraph of said section, and the last sentence of the second paragraph. 6. To delete in its entirety Section 2 of Chapter 4 dealing with the appointment, powers, and duties of Trial Justices, which have been abolished by State law. 7. To amend Sections 3, 6 and 8 of Chapter 6 to conform to changes in the State law by deleting the word "sergeant" or "sergeants" wherever they may appear and substituting therefor the word "sheriff" or "sheriffs" and by deleting the words "and the three (3) justices of the peace" from the second paragraph under Section 3. 8. To amend Section 3 of Chapter 8 so that failure of the Planning Commission to act on an amendment to the City plan within sixty days (now thirty days) of its submission to the Planning Commission, unless such time shall be extended by Council, shall be deemed approval of said amendment by the Planning Commission when the Commission notifies the owner or owners or their agents by certified mail.
