A. Gard, Sr., briefed Council on the reasons for suggesting <br /> <br />that the City Code be amended, motion was made, seconded, and carried on the unanimous <br /> <br />vote of all members present, that the City Code be amended as follows: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this l2th day of February, 1974, that Section <br />ll-9 of the Martinsville Code of Laws be amended to read as follows: <br /> <br />Section ll-9. - Definition <br /> <br />1. The term "Public Dance" shall, for the purpose of this ordinance, be <br />taken to mean any dance to which the public is admitted, which is held <br />and conducted for a profit, directly or indirectly, including those dances <br />held for non-profit or charitable organizations; and the term "Public Dance <br />Hall" shall be taken to mean any place, building, or portion of any building <br />where public dancing is permitted, and where the public may gain admission, <br />with or without payment of a fee. <br /> <br />2. "Person" shall be any person, firm, corporation, society, club, <br />association or organization, sponsoring or conducting any public dance. <br /> <br />3. "Operator" shall be any operator, proprietor, lessee, manager or <br />employee of any public dance hall. <br /> <br />AND, BE IT FURTHER ORDAINED that Section ll-lO be amended to read as <br />follows: <br /> <br />Section ll-lO. - Same - Permit Requirements6 <br /> <br />1. It shall be unlawful for any person to maintain, conduct or operate <br />any public dance in the City of Martinsville unless there shall have <br />first been obtained from the City Manager a permit in writing permitting <br />the same to be held. Any person desiring to hold such public dance shall <br />first make application to the City Manager at least ten (lO) calendar days <br />in advance of the time for holding the same; provided, however, that an <br />annual permit may be issued for dances held and conducted in regularly <br />established and licensed places used principally for dances. Application <br />for a public dance permit shall be made in writing on forms to be provided <br />by the office of the City Manager. <br />
