The City Manager noted that each member of Council had been provided with a copy of a proposed ordinance which would more closely regulate the operation of public dance halls and, after Chief of Police F. A. Gard, Sr., briefed Council on the reasons for suggesting that the City Code be amended, motion was made, seconded, and carried on the unanimous vote of all members present, that the City Code be amended as follows: BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this l2th day of February, 1974, that Section ll-9 of the Martinsville Code of Laws be amended to read as follows: Section ll-9. - Definition 1. The term "Public Dance" shall, for the purpose of this ordinance, be taken to mean any dance to which the public is admitted, which is held and conducted for a profit, directly or indirectly, including those dances held for non-profit or charitable organizations; and the term "Public Dance Hall" shall be taken to mean any place, building, or portion of any building where public dancing is permitted, and where the public may gain admission, with or without payment of a fee. 2. "Person" shall be any person, firm, corporation, society, club, association or organization, sponsoring or conducting any public dance. 3. "Operator" shall be any operator, proprietor, lessee, manager or employee of any public dance hall. AND, BE IT FURTHER ORDAINED that Section ll-lO be amended to read as follows: Section ll-lO. - Same - Permit Requirements6 1. It shall be unlawful for any person to maintain, conduct or operate any public dance in the City of Martinsville unless there shall have first been obtained from the City Manager a permit in writing permitting the same to be held. Any person desiring to hold such public dance shall first make application to the City Manager at least ten (lO) calendar days in advance of the time for holding the same; provided, however, that an annual permit may be issued for dances held and conducted in regularly established and licensed places used principally for dances. Application for a public dance permit shall be made in writing on forms to be provided by the office of the City Manager.
