<br />)2,' <br />.; '1 <br /> <br />JANUARY 22, 1974 <br /> <br />TUESDAY <br /> <br />manner to insure an accurate measurement of waste entering the City's system and to insure <br />that samples of waste are obtained for testing purposes. Where meters, in use or subsequently <br />installed, are inadequate in operation or performance or are determined by the City to be <br />inadequate in size, the City may direct the Authority to replace such meters with satisfactory <br />meters. At each new point of delivery to the City and at each present point of delivery <br />of wastes to the City where a recording flow meter is not now installed or, being installed, <br />is inadequate in size, operation or performance, the City may direct the Authority to <br />procure, install, operate and maintain adequate recording flow meters and any necessary <br />related facilities at or near the point of connection of the Authority sewer line with the <br />City sewer line. In event of termination of this contract or in event of discontinuance <br />of the use of any Authority sewer lines affected hereby, any meter or meters relating <br />thereto will be the property of the Authority. <br /> <br />It is recognized that in order to meter sewage flow in a line there must be <br />sufficient quantity consistently in the line for the metering device to register accurately. <br />Therefore, there are and will be locations where the number of connections to the line <br />and subsequent sewage flows would render metering impractical. If the service area of any <br />line is of such characteristic that the operation and functioning of metering equipment <br />would be impractical due to lack of flow, the quantity of flow entering the City's system <br />from such lines shall be determined from the actual amount of water used by all residential, <br />commercial and industrial buildings within such areas connected to the Authority's system <br />as determined by water meters owned by the Authority or in such other manner as may be <br />agreed upon by the contract parties, an allowance being made for infiltration or other <br />factors known or reasonably expected to exist. If the service area characteristics <br />change for any such line so as to render metering of such lines practical, a meter shall be <br />installed in accordance with the provision of Paragraph II. C., supra. <br /> <br />As of the first day of the month immediately following the date of this contract, <br />and monthly thereafter, the City shall read all meters recording flow from Authority sewer <br />lines into City sewer lines. Such meter readings, plus the calculated sewage flow of any <br />then unmetered lines, shall be the basis of charges made to the Authority under Sections <br />IV and IX, infra, of this contract. It is agreed that the Authority shall deliver to the <br />City, each month, a sheet indicating the meter readings of each meter recording flow <br />reaching the City system from the AREA, which sheet shall show the amount of water used <br />or total flow reaching the City system. The Authority agrees to maintain the meters in <br />such a manner as to insure proper measurement of flow. The City shall have the privilege <br />of checking said meters to determine their accuracy and if it is found by such test that <br />any of such meters are not registering flow accurately as per American Water Works <br />Association standards, upon notification by the City of any inaccuracies of said meters, <br />the Authority shall proceed forthwith to make repairs or replacements as necessary to <br />insure that the quantity of water is measured accurately. Should weather conditions, <br />malfunctioning of meter or other circumstances beyond immediate remedy reasonably prohibit <br />the City from a regular reading of a meter, then the sewage flow through such line for the <br />particular month shall be the average of the sewage flow for the three consecutive <br />preceding months wherein actual sewage flows were recorded. Records of metered and <br />calculated sewage flow, obtained and maintained by the City, shall be reported to the <br />Authority, and such records shall be available for inspection by the Authority during all <br />normal business hours. <br /> <br />The City may request the Authority in writing to provide, install and maintain a <br />bypass connection around each such meter, for emergency use, only; and the City may request <br />the Authority in writing to provide, install and maintain manually or automatically operated <br />facilities for taking samples at each said metering place or at any point of delivery of <br />Authority wastes. <br />
