<br />D. It is expressly understood and agreed between the parties hereto that the
<br />City, by this contract, undertakes and obligates itself to treat wastes originating
<br />within the AREA, and that the charges hereinafter provided for are charges intended to
<br />be made to the Authority for services rendered the AREA as a unit.
<br />
<br />III. CHARACTER OF WASTES:
<br />
<br />A. The character of wastes delivered by the Authority and accepted by the City,
<br />under this contract, shall consist only of normal sewage except as hereinafter provided.
<br />The Authority, therefore, especially covenants and agrees that the AREA's wastes, as
<br />delivered to the City's sewer lines, shall not contain oils, hair from tanneries, feathers,
<br />paunch contents, grit from packing plants, chrome, plating wastes, radioactive materials,
<br />or other substances not normally regarded as sewage, or which are or may be detrimental
<br />to the sewage treatment facilities or process, nor shall such wastes contain introduced storm
<br />or surface waters. The Authority covenants and agrees that it will neither permit nor
<br />allow nor permit to continue to exist any connection for rain or foundation drains or
<br />for storm or surface water disposal to be made to the sanitary sewer system, nor any other
<br />connection to said sanitary sewer system which allows rain, storm and surface waters to be
<br />introduced into said system, within the AREA or to its sewer lines leading therefrom and
<br />connecting with any of the City's sewer system at any point. Should it become evident
<br />that the Authority is delivering to the City's intercepting sewer system materials
<br />excluded by this contract, the City, through its City Manager, shall notify the Authority,
<br />by registered mail with return receipt, through its chief administrative officer, of such
<br />fact, and, upon being so notified, the Authority covenants and agrees to forthwith
<br />eliminate delivery of such objectionable material. Should it become evident that the
<br />Authority is delivering to the City's sewer lines any such excluded materials, and the
<br />Authority be notified of such fact, and the Authority does not promptly eliminate
<br />delivery of such objectionable materials then, and in such event, the City shall have
<br />the right to forthwith take such action as necessary to secure compliance with this
<br />contract, in whole or to the extent of such offending area. The Authority shall be
<br />liable to the City for any damage resulting to the City's sewer lines, treatment plant or
<br />treatment process agreed or shown to have been caused by Authority's delivery to the
<br />City of any such excluded or objectionable material.

<br />The City covenants and agrees that such limitations or restrictions on
<br />character and strength of wastes, as herein prescribed in Paragraph III. A., supra,
<br />and Paragraph III. B., infra, shall be applicable to wastes collected by the City with
<br />its sewerage system and delivered to the treatment plant. The City shall bear the
<br />sole financial responsibility for the prompt repair of any damage to jointly used
<br />facilities resulting from the introduction of such excluded or objectionable material
<br />into said facilities, except by delivery from the Authority.

<br />B. The strength of normal wastes delivered by the Authority for treatment by
<br />the City at the base rate of charges set out in Sections IV and IX, infra, shall, at no
<br />time and at no point of delivery to the City have a B.O.D. that exceeds 300 p.p.m., or
<br />a suspended solids content that exceeds 400 p.p.m., at any point of delivery to the
<br />City's intercepting sewer. Wastes of strength exceeding the aforesaid limits shall be
<br />subject to charges as provided in Paragraph C. of this section and in Sections IV
<br />and IX, infra, and the Authority covenants and agrees to take whatever measures are
<br />necessary to keep the strength of its wastes below the above-stated maximums. The
