or ~-' ,) FRIDAY DECEMBER 7, 1973 the Henry County Public Service Authority have been directed to show cause as to why both entities should not be required to construct secondary sewage treatment facilities without Federal-State aid: CITY OF MARTINSVILLE, VIRGINIA WITH: AGREEMENT HENRY COUNTY, VIRGINIA, PUBLIC SERVICE AUTHORITY WHEREAS, the City of Martinsville, Virginia, sometimes hereinafter referred to as the City, is the owner of a sewage treatment facility which has been constructed at considerable cost to its citizens, and, WHEREAS, the City and Henry County Public Service Authority, sometimes hereinafter referred to as the Authority, recognize the fact that it would be cheaper for the citizens of the City of Martinsville and Henry County for said facility to be operated on a regional basis rather than to have duplicating facilities, and, WHEREAS, the City, provided that it can obtain a grant of Federal and State monies equal to 85 per cent of the cost, intends to expand and upgrade the capacity of its facility, and, WHEREAS, the Authority needs to have allocated a portion of the capacity of the present facility to service that area identified as the Beaver Creek Watershed, and, WHEREAS, the Authority needs to have allocated a portion of the capacity of the expanded facility in order to serve that area defined as Regional Plan Area, that City-County area as designated on Exhibit 1, identified as Plate 18, titled "Incremental Service Areas and Sewage Facilities for Smith River," of the Water and Wastewater Disposal Plan prepared for West Piedmont Planning District Commission by Wiley & Wilson~ Engineers, Architects & Planners, and dated September 10, 1973, and, WHEREAS, the City is willing to make said allocations to the Authority provided that the Authority shall pay the City for same, NOW THEREFORE, this agreement made and entered into the 7th day of December, 1973, by and between the City of Martinsville, Virginia and the Henry County Public Service Authority; _ WIT N E SSE T H - That for and in consideration of the mutual covenants and agreements hereinafter set forth, the City does hereby allocate in perpetuity to the Authority 12-1/2 per cent of the capacity of the existing treatment -- ..
