<br />or <br />~-' ,) <br /> <br />FRIDAY <br /> <br />DECEMBER 7, 1973 <br /> <br />the Henry County Public Service Authority have been directed to show cause <br /> <br />as to why both entities should not be required to construct secondary <br /> <br />sewage treatment facilities without Federal-State aid: <br /> <br />CITY OF MARTINSVILLE, VIRGINIA <br /> <br />WITH: <br /> <br />AGREEMENT <br /> <br />HENRY COUNTY, VIRGINIA, PUBLIC SERVICE AUTHORITY <br /> <br />WHEREAS, the City of Martinsville, Virginia, sometimes hereinafter <br />referred to as the City, is the owner of a sewage treatment facility <br />which has been constructed at considerable cost to its citizens, and, <br /> <br />WHEREAS, the City and Henry County Public Service Authority, sometimes <br />hereinafter referred to as the Authority, recognize the fact that it would be <br />cheaper for the citizens of the City of Martinsville and Henry County for <br />said facility to be operated on a regional basis rather than to have <br />duplicating facilities, and, <br /> <br />WHEREAS, the City, provided that it can obtain a grant of Federal and <br />State monies equal to 85 per cent of the cost, intends to expand and <br />upgrade the capacity of its facility, and, <br /> <br />WHEREAS, the Authority needs to have allocated a portion of the capacity <br />of the present facility to service that area identified as the Beaver <br />Creek Watershed, and, <br /> <br />WHEREAS, the Authority needs to have allocated a portion of the capacity <br />of the expanded facility in order to serve that area defined as Regional <br />Plan Area, that City-County area as designated on Exhibit 1, identified <br />as Plate 18, titled "Incremental Service Areas and Sewage Facilities for <br />Smith River," of the Water and Wastewater Disposal Plan prepared for <br />West Piedmont Planning District Commission by Wiley & Wilson~ Engineers, <br />Architects & Planners, and dated September 10, 1973, and, <br /> <br />WHEREAS, the City is willing to make said allocations to the Authority <br />provided that the Authority shall pay the City for same, <br /> <br />NOW THEREFORE, this agreement made and entered into the 7th day <br />of December, 1973, by and between the City of Martinsville, Virginia <br />and the Henry County Public Service Authority; <br /> <br />_ WIT N E SSE T H - <br /> <br />That for and in consideration of the mutual covenants and agreements <br />hereinafter set forth, the City does hereby allocate in perpetuity to <br />the Authority 12-1/2 per cent of the capacity of the existing treatment <br /> <br />-- .. <br />
