<br />l'"'- <br />t <br /> <br />TUESDAY <br /> <br />FEBRUARY 13, 1973 <br /> <br />- <br /> <br />seconded by Councilman Boaz, and carried unanimously that the City accept the <br /> <br />recommendation of the Planning Commission, thereby granting said Special Use <br /> <br />Permit. <br /> <br />Council conducted a duly-advertised public hearing on the petition submitted <br /> <br />(11-14-72) by Lester Lumber Company, that unopened portions of Elizabeth Street <br /> <br /><..-..- <br /> <br />and Elizabeth Boulevard, in the vicinity of Commonwealth Boulevard, be abandoned. <br /> <br />No citizen spoke in favor of or in opposition to the proposal. After reviewing <br /> <br />the Planning Commission's recommendation that the petition be granted, motion <br /> <br />was made by Mr. Hartford, seconded by Mr. Hobson, and carried unanimously, that <br /> <br />the petition for closing be granted, by ordinance, as follows: <br /> <br />WHEREAS, by petition filed November 20, 1972, with Martinsville City <br />Council, Mr. George W. Lester, II, representing Lester Lumber Company~ Inc., <br />requested the closing and vacating of unused portions of Boulevard Street <br />and Elizabeth Street, in the vicinity of Commonwealth Boulevard; and, <br /> <br />WHEREAS, by report dated January 5, 1973, the Martinsville Planning <br />Commission recommended to Martinsville City Council that petitioner's <br />request be granted; and, <br /> <br />WHEREAS, at its regular meeting held on FebTuary 13, 1973, pursuant to <br />Section 3 of Chapter 8 of the Code of the City of Martinsville, Virginia, <br />said City CQuncil conducted a duly-advertised public hearing on said <br />request, at which meeting no objections thereto were registered; now, <br />therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this 13th day of Feb~uary, 1973, that it doth <br />accept the Planning Commission's aforesaid recommendation and does hereby <br />order and declare closed and vacated portions of Boulevard Street, extending <br />between the right-of-way lines of Liberty Street and Commonwealth Boulevard, <br />and of Elizabeth Street extending southward from the boundary line of <br />Commonwealth Boulevard approximately 440 feet, Boulevard Street being <br />approximately 100 feet in width and Elizabeth Street being approximately <br />40 feet in width, petitioner owning all of the property contiguous: to the <br />said Boulevard and Elizabeth Street as identified on a plat of survey <br />prepared by J. A. Gustin & Associates, dated December 28, 1972, Boulevard <br />Street consisting of 1.35 parts of an acre and Elizabeth Street consisting <br />of 0.4 parts of an acre, both to be quit-claimed to Lester Lumber Company, <br />Inc.; and, <br /> <br />BE IT FURTHER ORDAINED by said Council that a copy of this ordinance be <br />forthwith filed with the Clerk of Martinsville Corporation Court as directive <br />and authorization to mark his records accordingly. <br />
