<br />sell therefor in like manner as a collector of taxes may destrain and
<br />sell for State taxes, and shall have in other respects the power to
<br />enforce the collection thereof: provided, however, that no assessment
<br />shall be made for taxes on any real estate, within said corporate limits,
<br />except the lots and buildings embraced in the plan of said town, unless
<br />the said tract is wholly included within the limits of said corporation,
<br />until an election is held by law for said sergeant. The board of trustees
<br />shall by a vote of a majority of a quorum, appoint one to act until his
<br />successor is elected and qualified.
<br />
<br />6. This act shall be in force from its passage.

<br />An ACT to amend and re-enact an act passed January 16th, 1878, entitled an
<br />act to incorporate the town of Martinsville, in the county of Henry.

<br />1. Be it enacted by the general assembly of Virginia, That sections
<br />one, two and four of the charter of the town of Martinsville, be amended
<br />and re-enacted so as to read as follows:
<br />
<br />Section 1. The town of Martinsville, in the county of Henry, chartered
<br />by an act of assembly passed January sixteen, eighteen hundred and seventy-
<br />three, shall, by that name, have and exercise all the powers, and be subject
<br />to all the duties which now belong to said town, and be subject to all the
<br />provisions of the existing law with regard to towns, except as herein may be
<br />otherwise provided.
<br />
<br />Section 2. The boundaries of said town shall be as follows, to-wit:
<br />Beginning at the upper corner of M. T. Penn's, on the turnpike; thence
<br />south fifty degrees west, seven hundred and fifty-six yards to the junction
<br />of the river road with H. M. Drewry's road, near a barn; thence south
<br />eighty-nine degrees west, seven hundred and twenty-nine yards to a large
<br />poplar tree in the fork of Aaron's branch; thence down said branch as it
<br />meanders, five hundred and ninety-yards, to J. B. Lavender's corner, on the
<br />turnpike; thence north twenty-six degrees thirty minutes west, twelve
<br />hundred and ten yards to Gabe Smith's corner, on the Waller's Ford road;
<br />thence north fifty-four degrees east, three hundred and ten yards to the
<br />corner of Fulcher's fence, on Jones' path; thence north sixty-one degrees
<br />east, nine hundred and eighty-eight yards to mile post number forty-three,
<br />on the Danville and New river railroad; thence up Poplar Spring branch, as
<br />it meanders, one thousand, seven hundred and twenty yards to mile post
<br />number forty-two, on said railroad, and thence south eighteen degrees east,
<br />three hundred yards to the beginning.

<br />Section 4. The qualified voters of the town shall elect a president,
<br />who shall preside at the meetings of the board of trustees, and when they
<br />are equally divided, shall, in addition to his individual vote, give the
