<br />, 'j <br /> <br />TUESDAY <br /> <br />NOVEMBER 14, 1972 <br /> <br />- <br /> <br />Accordingly, in accepting the Mayor's suggestion, motion was made, seconded and <br /> <br />carried that the special CBD Committee be asked to incorporate this situation in <br /> <br />its deliberations and report, hopefully in January, as to this segment. <br /> <br />Council conducted a duly-advertised public hearing on a petition submitted by <br /> <br />Mr. Ralph C. Lester requesting the closing of the portion of Hickory Street <br /> <br />,- <br /> <br />lying between Middle Street and Highway 57 in the West End section of the City. <br /> <br />It was explained that petitioner owned the property on both sides of the section <br /> <br />of street proposed for closing. No citizen spoke in favor of or in opposition to <br /> <br />the proposal. After reviewing the Planning Commission's recommendation that the <br /> <br />petition be granted, subject to the submission of a map showing all property <br /> <br />abutting the portion of the street requested to be closed, its ownership and the <br /> <br />disposition of the right-of-way in the event of the closing, it was determined <br /> <br />that such map filing is necessary in order to completely satisfy legal <br /> <br />technicalities involved in the closing, whereupon motion was made, duly seconded <br /> <br />and carried, that the petition for closing be granted, by ordinance, as follows: <br /> <br />AN ORDINANCE PROVIDING FOR THE CLOSING AND VACATING OF A PORTION OF <br />HICKORY STREET, BETWEEN FAYETTE AND MIDDLE STREETS <br /> <br />WHEREAS, by petition filed August 4, 1972, with Martinsville City Council, <br />Mr. Ralph C. Lester, requesting the closing and vacating of an unused <br />portion of Hickory Street between Fayette Street and Middle Street; and <br /> <br />WHEREAS, by report dated October 10, 1972, the Martinsville Planning <br />Commission recommended to Martinsville City Council that petitioner's <br />request be granted, subject to the provision of certain maps; and <br /> <br />WHEREAS, at its regular meeting held on November 14, 1972, pursuant to <br />Section 3 of Chapter 8 of the Charter of the City of Martinsville, Virginia, <br />City Council conducted a duly-advertised public hearing on said request, <br />at which meeting no objections thereto were registered; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this fourteenth day of November, 1972, that it <br />doth accept the Planning Commission's aforesaid recommendation and does <br />hereby order and declare that said portion of Hickory Street, extending a <br />distance of approximately 210 feet between the east boundary line of <br /> <br />, <br />
