<br />i) i) <br />l~ f."" <br /> <br />TUESDAY <br /> <br />OCTOBER 10, 1972 <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this tenth day of October, 1972, that it opposes <br />the proposed changes in rates and charges which the Appalachian Power <br />Company has tendered for filing with the Federal Power Commission in <br />Docket No. E7775; that the employment of the law offices of Northcutt Ely <br />of Washington, D. C., as special counsel to protect the interest of the <br />City of Martinsville in this matter is hereby authorized; and that <br />Attorney Ely is hereby authorized to take all necessary action to protect <br />the City's interests, including intervention in the Federal Power Commission <br />proceeding, filing of all necessary protests, motions and briefs, and <br />submission of argument and the taking of any necessary appeals. <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this tenth day of October, 1972, that compensation <br />of the law offices of Northcutt Ely (of Washington, D. C.) in the matter of <br />the rate increases proposed by the Appalachian Power Company, to be paid by <br />the City of Martinsville, should be as follows: <br /> <br />1. A monthly retainer of $775.00, plus time charges; <br />2. Time charges at the rate of $75.00 per hour for services of <br />Mr. Ely; $50.00 per hour for services of his associates; $25.00 <br />per hour for services of junior associates; and $10.00 per hour <br />for time applied by law cl_rks; provided that time applied jointly <br />to the case of City of Martinsville and the cases of the other <br />cities involved in said proceeding (who engage the services of the <br />law offices of Northcutt Ely) shall be prorated in proportion to <br />the number of kilowatt hours of energy purchased by each city from <br />said Appalachian Power Company; <br />3. Out-of-pocket expenses, costs, etc., but not general office overhead, <br />shall be reimbursed in the same ratio as above; <br />4. This agreement shall be in effect for six months from October 10, <br />1972, and thereafter may be terminated by the City or by Mr. Ely on <br />thirty (30) days written notice; and <br />5.
