Meanwhile, upon inquiry regarding the positions of Clerk of <br /> <br />Council and of City Attorney, Council was advised that persons filling <br /> <br />these positions (from prior appointments) serve at the pleasure or will of <br /> <br />Council and (that) it is not necessary for Council formally to reappoint <br /> <br />persons presently filling these positions. <br /> <br />City Manager Noland notified Council that official notice has been received <br /> <br />by the City Manager and the City Attorney of Lee Telephone Company's rate <br /> <br />increase application now on file before the State Corporation Commission; <br /> <br />that the City has until October 9, 1972 to file--if it so desires--an answer <br /> <br />to the application or petition; and, that the State Corporation Commission has <br /> <br />set the date of October 18, 1972 for a public hearing thereon. City Manager <br /> <br />Noland then outlined the several recourses open to the City, viz., whether <br /> <br />to let pass unchallenged or to challenge, or to intervene actively. This <br /> <br />last-named recourse, City Manager Noland pointed out, would require retaining <br /> <br />of expert assistance, such as rate specialists, and would result in considerable <br /> <br />expense to the City and/or to the City and other participating jurisdictions. <br /> <br />Members of Council expressed no opposition to what is considered a reasonable <br /> <br />return by petitioner on its investment; however, Council, in pointing out that <br /> <br />certain proposed increases would reflect slightly more than 50% increase, <br /> <br />expressed the opinion that petitioner's application should not go unchallenged; <br /> <br />whereupon motion, duly seconded and unanimously carried, Council directed that <br /> <br />other area jurisdictions served by Lee Telephone Company be contacted to <br /> <br />ascertain their interest in intervening in the case, and protesting thereof, <br /> <br />and (that) Council's position herein in the interest of its citizens be set <br /> <br />forth in letters to the City's representatives in the Virginia General Assembly <br /> <br />'"".---..-----'" <br />
