<br />4~ <br /> <br />WEDNESDAY <br /> <br />SEPTEMBER 14, 1977 <br /> <br />_. <br /> <br />In response, City Attorney Worthy expressed his opinion that Council is not obligated to <br /> <br />refer any property rezoning petition to the Planning Commission unless a rezoning of such <br /> <br />property is contemplated and, in the case of the Roycroft petition filed subsequent to <br /> <br />Lanier Farm's petition, while the Roycroft petition may have "standing" under the <br /> <br />Attorney General's ruling, there has been no indication expressed by the Council that <br /> <br />it contemplates rezoning the property in the manner sought by Dr. Roycroft; accordingly, <br /> <br />City Attorney Worthy recommended that Council hold the Roycroft petition in abeyance <br /> <br />until (after) Council has taken final action on the Lanier Farm petition. <br /> <br />Mr. Jackson C. Dodge, President of Lanier Farm, Inc., reviewed the history of the <br /> <br />development of Lanier Farm's Druid Hills Shopping Center, noting that a portion of the <br /> <br />property on the south side of Spruce Street was zoned "C-l" in 1961 in anticipation of <br /> <br />future and further development of the shopping center and that the area, for which <br /> <br />additional "C-l" zoning is being sought, is required in order to accommodate a new <br /> <br />grocery supermarket, further noting that the premises (across the street) recently <br /> <br />vacated by the Kroger Company, even with an addition of some 5,000 square feet at an <br /> <br />estimated construction cost of $302,000.00, will not accommodate the needs of <br /> <br />prospective supermarket tenants, nor would such an addition be economically feasible. <br /> <br />As to the future usage of the premises vacated by the Kroger Company, Mr. Dodge <br /> <br />indicated that these premises would be converted to an office-type complex. <br /> <br />Mr. Earle W. Greene, local realtor and developer, pointed out that the successful <br /> <br />development and operation of any shopping center demands within such a center a grocery <br /> <br />supermarket and, without the replacing of the former Kroger Store in the Druid Hills <br /> <br />Shopping Center by such a supermarket as contemplated within the area sought to be <br /> <br />rezoned, the successful operation of the present shopping center would be in jeopardy. <br /> <br />Mr. Henry Wall, of Lanier Farm, Inc., presented two site plans for the proposed <br /> <br />development of the area, identified as "Site 1" and "Site 2", with proposed development <br /> <br />.,- <br />
