<br />~ <br /> <br />I STATEMENT OF INTENT <br /> <br />It is the intent of this ordinance to: <br /> <br />A. Prevent the loss of life and excess damage to property in flood hazard areas. <br /> <br />B. Promote health and safe use of flood plains and avoid disruption of commerce <br />and industry, extraordinary public expenditures for flood relief, and the <br />impairment of the tax base. <br /> <br />C. Restrict or prohibit uses which are dangerous to health, safety, or <br />property in times of flood. <br /> <br />D. Require that uses vulnerable to floods, including public facilities which <br />serve such uses, be protected against flood damage at the time of initial <br />construction. <br /> <br />II ENACTMENT OF ORDINANCE <br /> <br />\.Jhereas, the flood plain areas of the City of Nart:insville, Virgi,lia are subject <br />to periodic inundation which can result in loss of life, loss of property, the <br />creation of health and safety hazards, disruption of commerce and industry, <br />public expenditures for flood relief, and impairment of the tax base, all of <br />which adversely affect the public health, safety, and general welfare; and <br /> <br />Whereas, it is the purpose of this ordinance to promote the public health <br />safety, convenience, comfort, prosperity, and general welfare and to minimize <br />those losses; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsvi1le, Virginia: <br /> <br />The codified ordinances of the City of Martinsvil1e, Virginia are hereby <br />supplemented by the enactment of the Martinsville Flood Plain Ordinance to <br />read as follows: <br /> <br />III DEFINITIONS <br /> <br />A. APPRAISED VALUE - The fair market value of the structures and/or land as <br />shown on the most recent records of the Commissioner of Revenue. <br /> <br />,- <br /> <br />B. BOARD - Wherever the term "Board" is used in this ordinance it shall mean <br />the Board of Adjustment and Appeals which shall be the same Board appointed <br />to serve as the Board of Appeals for the Martinsville Erosion and Sediment <br />Control Ordinance. <br /> <br />C. BUILDING OFFICIAL - The appointed Building Official of the City of <br />Martinsville. <br /> <br />D. CHANNEL - A natural or artificial depression of perceptible extent, with <br />a definite bed and banks to confine and conduct flowing water. <br /> <br />-1- <br /> <br />. .__...._______...._--".9'.-.. <br />
