Edwards' intended usage, with Council already having

conducted a duly-advertised public hearing at its July 27th meeting on the

proposed "C-2" amendment, at which public hearing no objections were

registered but, in deference to the Planning Commission's July 20th report

and request, Council continued this matter to its August 10th meeting, the

Planning Commission (under date of August 6, 1976) reported as follows:

The Planning Commission wishes to advise Council that at
the Commission's regular meeting on Tuesday, August 3,
consideration was given to the evidence heard at its
July 15 Public Hearing on the proposal to amend the City
Zoning Ordinance to allow used car lots and/or garages in
the C-2 Commercial zone. Following much discussion of
this matter the Commission decided that more in-depth
study of this situation would be required and that an
additional Public Hearing should be held in order to
determine the best interest of the community. This
matter is directly related to the Central Business
District zoning and would affect other areas of the
City such as properties at Southside and other properties
further out Fayette Street in the West End area.
Therefore, this matter was carried over on the
Commission's agenda and further study will be given to
the problem.

Mr. William C. Edwards, one of the joint petitioners, pointed out that to

continue this matter through another series of public hearings, as proposed

by the Planning Commission, would unnecessarily cause him inconvenience and

expenses, noting that three months have elapsed since he first filed his

petition. Mr. Edwards requested, further, if the proposed amendment can

not be or is not effected, that he be issued a Special-Use Permit to enable

him to begin the operation of a used-car lot and/or repair garage. After

some discussion, particularly as to whether legal requirements have been

complied with in order for Council to adopt--if it desires--the proposed

._~...,_,..__,,,_._,_~~_,,",,._,,..,",_,_...,,.,...,,,~..,,",,,_,~_"_,.~,_"_w,,,,"__,,,.,..,,_,..,,,...n.",_,,,_~_,,,~___
