J C;, t~ ; f..' ::t TUESDAY JULY 13, 1976 WHEREAS, it has been proposed that the section of Spruce Street, within Henry County and the City of Martinsvi1le, from the terminus of existing curb-and-gutter thereon (near Prospect Hill Drive) in East Martinsvil1e to the City's east corporate limits near Mulberry Creek, be reconstructed (with a portion thereof to be relocated) by the Virginia Department of Highways & Transportation in conjunction with the proposed reconstruction and/or relocation of Route 650 in the County of Henry; and, WHEREAS, such proposal provides for the financing thereof with Urban funds for that portion or those portions within the City of Martinsvi1le, pursuant to the shared-cost formula hereinafter set forth, and with Henry County Secondary Road funds for that portion or those portions within the County of Henry; now, therefore, BE IT RESOLVED by the Council of the City of Martinsvil1e, Virginia, in regular meeting assembled this 13th day of July, 1976, as follows: viz., that: (1) The Virginia Department of Highways & Transportation be, and it is hereby, requested to establish a project within the corporate limits of the City of Martinsvil1e, Virginia, to construct, reconstruct and/or relocate that section of Spruce Street from the terminus of its existing curb-and-gutter (near Prospect Hill Drive) to the City's east corporate limits near Mulberry Creek, as shown on Plates 53 and 54 of the 1969 Martinsvil1e Thoroughfare Plan prepared by the Virginia Department of Highways & Transportation; (2) The City of Martinsvil1e hereby agrees to pay its share of the cost of said project, as to those portions within the City's corporate limits, including the cost of preliminary engineering, right-of-way, and construction or reconstruction, under the cost formula of 85% by the Virginia Department of Highways & Transportation and 15% by the City of Martinsvil1e; and, (3) The City of Martinsvi11e further agrees, if the said project is established as herein requested and thereafter the City of Martinsvil1e decides not to proceed further with said project, to reimburse the Virginia Department of Highways & Transportation for 100% of the cost incurred for said project to the time the City decides not to proceed further.
