<br />~ ~ <br />~J... <br /> <br />TUESDAY <br /> <br />JUNE 22, 1976 <br /> <br />BE IT ORDAINED by the Council of the City of Martinsvil1e, Virginia, <br />in regular meeting assembled this twenty-second day of June, 1976, <br />that subsection (a) of Section 3-9 of Chapter 3 of the Code of the <br />City of Martinsvil1e, Virginia, be--and is hereby--amended to read <br />as follows: <br /> <br />-,"-"'" <br /> <br />Section 3-9. <br />(a) It shall be unlawful for the owner or keeper of any <br />dog to allow such dog to run at large, at any time, within the <br />City even though the dog is both lawfully licensed and vaccinated. <br />For the purpose of this section, the term "to run at large" <br />shall mean to roam, loiter, walk, run or be off the premises of <br />the owner or keeper without being physically carried or held by <br />leash, chain or other restraint or in the physical presence of a <br />responsible person and under the command of that person. <br />Any person violating the provisions of this section shall be <br />guilty of a misdemeanor which shall be punishable by a fine of <br />not less than five dollars ($5.00) nor more than twenty-five <br />dollars ($25.00), and for a second and for each successive offense <br />thereafter by a fine of not less than fifteen dollars ($15.00) nor <br />more than fifty dollars ($50.00). <br />In lieu of the issuance of a criminal warrant charging a <br />violation of the provisions of this section, and, in addition to, <br />or, in lieu of the impounding required by Section 3-12 in <br />accordance with Section 3-10 of this article, the impounding officer, <br />or any other authorized official designated by the City Manager, may <br />issue to the known owner or keeper of any dog ~ound at large in the <br />City a notice of violation of the provisions of this section. Such <br />notice shall impose upon the owner or keeper a penalty of ten dollars <br />($10.00) which may, at the discretion of the owner or keeper, be paid <br />to the City Treasurer within seventy-two (72) hours in full satis- <br />faction of the assessed penalty. In the event such penalty is not <br />paid within the time prescribed, a criminal warrant charging a <br />violation of the provisions of this section shall be issued. <br /> <br />BE IT FURTHER ORDAINED by said Council that this ordinance shall become <br />effective September 1, 1976. <br /> <br />",- <br /> <br />Pursuant to recommendation of the Planning Commission, Council denied the petition <br /> <br />submitted May 11, 1976 by Messrs. William C. & Donald H. Edwards, requesting the <br /> <br />rezoning of petitioners' property at 208 Fayette Street to a "C-3" zoning to <br /> <br />permit the conduct of a used-car business at that location, the Planning Commission <br /> <br />--- <br /> <br />pointing out that the requested rezoning would constitute "spot" zoning which might <br /> <br />in the future open the property for another use not compatible with "C-3" zoning. <br /> <br />Meanwhile, the Commission recommended that the Zoning Code be amended to allow the <br /> <br />conduct of used-car lots and/or repair garages in "C-2 Commercial District" zoning <br />
