<br />~. r:;- I <br />JL0 <br /> <br />TUESDAY <br /> <br />FEBRUARY 24~ 1976 <br /> <br />Upon motion, duly seconded and unanimously carried (by recorded vote)~ <br /> <br />Council convened into an Executive Session to consider a sidewalk <br /> <br />right-of-way contractual matter and~ also~ two matters now being <br /> <br />litigated. Following said Executive Session, Council reconvened into <br /> <br />regular session and announced that no action is now required on these <br /> <br />matters. <br /> <br />Council was adjourned. <br /> <br />L. Yeama~'_'9-erk of Council <br /> <br />ADD END U M <br /> <br />Subsequent to the writing of these minutes, it was brought to the <br />attention of Council's Clerk that, with reference to the conditions <br />and variances made a part of the Special-Use Permit herein issued to <br />Nationwide Homes, Inc.~ to allow for development by applicant of a <br />unified housing complex in East Martinsvi1le, off Brookda1e Road~ <br />during public hearing thereon not only did Mr. James W. Severt <br />(President & Chief Executive Officer of Nationwide Homes, app1icant)~ <br />in person, call to Council's attention that the Planning Commission's <br />report and recommendation omitted the proviso that applicant be <br />allowed a side-setback on corner lots for the same distance as <br />required on lots fronting on only one street but a1so~ as confirmed <br />by Mr. James H. Ford, Chairman of the Planning Commission~ and <br />from Martinsvi1le Bulletin's press coverage~ in its edition of <br />January 16, 1976 following the Commission's meeting and action on <br />this matter on January 15~ 1976, this proviso was inadvertently <br />omitted from the Commission's recommendation. Accordingly, inasmuch <br />as Council's action, in granting applicant the Special-Use Permit, <br />included acceptance of the Commission's recomended approval, said <br />proviso is made a part of said Special-Use Permit. <br /> <br />-~. <br />W.
