13

TUESDAY

JANUARY 27, 1976

,-

of the law firm of Broaddus, Epperly & Broaddus. Following this session,

Council reconvened into regular session and announced that it had been

briefed on this matter by its legal counsel (City Attorney David B. Worthy)

and that its reaction to the petition is favorable~ pending further study of

the economic factors involved.

..-

Council referred to the Planning Commission~ for its consideration and

recommendation a petition filed by Mr. & Mrs. J. Bailey Henderson requesting

the rezoning of petitioner's rroperty at 231 Starling Avenue from "R-6

Residential" to "P-2 Professional".

Mr. John Jacob Astor Sanders~ of 308 Starling Avenue, appeared before Council

and filed his protest against the recent reclassification for electric

service~ i.e.~ electric tariff application, by the City on his apartment house

properties located at 403 Virginia Street~ 410 Virginia Street~ and 712

Princeton Street~ without prior notice thereof, for which he--as 1and1ord--has

been responsible for the payment for such electric service, resulting in

much higher cost for electric service than would be otherwise if the service

were charged for under a residential classification. After some discussion

of this matter~ Council directed that any reclassification of accounts of like

nature be postponed, pending further study by Council and pending study by City

Attorney Worthy, whom Council asked to prepare guidelines and recommendation,

applicable to such situations~ for Council's consideration.

Council was adjourned.
