<br />_- n <br />.10 <br /> <br />TUESDAY <br /> <br />DECEMBER 30, 1975 <br /> <br />",- <br /> <br />(4) That the aforesaid repeal shall not affect any act or offense <br />done or committed, or any penalty, forfeiture or punishment incorrect, or <br />any right accruing or accrued, acquired or established or any protection <br />or proceeding pending at or on January 1, 1976; and, <br /> <br />(5) That all supplements to said Uniform Statewide Building Code be, <br />and the same hereby are, adopted by reference as a part of this ordinance. <br /> <br />In connection with the proposed construction of a facility for a new Kroger Store on <br /> <br />the south side of Commonwealth Boulevard and adjacent to Mitchell-Howell Ford <br /> <br />automobile dealership, Council authorized the construction by the City of some <br /> <br />350 feet of 8" sewer line required to serve this new store and, also, unanimously <br /> <br />authorized City Manager Noland to execute--on behalf of the City--a contract and/or <br /> <br />agreement with the Kroger Development Company and with The Lester Group, Inc., <br /> <br />developers of the property, providing for City-supplied water and sewer service <br /> <br />for this facility and for the terms and conditions the developers must meet. In <br /> <br />response to an inquiry from Councilman Fitz-Hugh, pertaining to not only current <br /> <br />traffic problems but also probable increased traffic problems in that area, the need <br /> <br />was cited for the eventual four-laning of Commonwealth Boulevard from Market Street <br /> <br />westward to Route 220 North, especially that portion of Commonwealth Boulevard which <br /> <br />extends from the City's corporate limits to Route 220 North, which portion would be <br /> <br />a State-Henry County project. Councilman Fitz-Hugh urged that an in-depth study be <br /> <br />given to ways and means of handling traffic along this street in advance of further <br /> <br />property development along this street. Council was reminded of the several <br /> <br />highway-street projects (viz., Brookdale Road, Mulberry Road Extension, and Commonwealth <br /> <br />Boulevard) for which the City is seekinp, State financial aid and of the probability, <br /> <br />in light of the State's current financial condition, that only one of the projects can <br /> <br />be undertaken at anyone time. <br /> <br />Council was adjourned. <br /> <br />~- <br />, ) ~ i--.:.:...) .....l '-" " ~ <br />W.
