<br />question of rezoning because Mr. Lester was not present at Council's
<br />
<br />August 26th public hearing at which (hearing) testimony was presented by
<br />
<br />both proponents and opponents. Councilman Lester informed the Council
<br />
<br />that, in advance of this meeting (i.e., September 9th), he has read the
<br />
<br />minutes of Council's August 26th meeting, through a copy furnished him,
<br />
<br />and has listened to the tapes recording all the testimony offered at said
<br />
<br />August 26th meeting; therefore, already being familar with the proceedings,
<br />
<br />he felt that he should exercise his appointed and/or elected duty to
<br />
<br />participate. Mr. Ralph C. Lester, Nationwide Homes' Board Chairman,
<br />
<br />reviewed with Council certain conversations he has had with Mr. Roy C. Stone
<br />
<br />in which Mr. Stone had offered to trade certain of Mr. Stone's property on
<br />
<br />the west side of Rives Road to Nationwide Homes in exchange for Nationwide
<br />
<br />Homes' property for which rezoning has been requested. Councilman Fitz-Hugh,
<br />
<br />although expressing the opinion that Rives Road is not necessarily a boundary
<br />
<br />line, in the area in question, between industrial operations and residential
<br />
<br />usage and, also, that the area is in a transitional process, indicated that
<br />
<br />he could not now sustain his prior-held opinion that the property should be
<br />
<br />rezoned in the light of the City Attorney's legal advice on this matter.

<br />Planning Commission Chairman James H. Ford, addressing the Council, reviewed
<br />
<br />the role of the Planning Commission not only in its deliberations of matters
<br />
<br />referred to the Commission by City Council but also the proceedings of the
<br />
<br />Commission in its development, with Wiley & Wilson, of the City's
<br />
<br />comprehensive plan, with such review not for the purpose of representing
<br />
<br />any interest but merely to portray and reflect the fact that the Commission
<br />
<br />must operate within and under directions adopted by the Council. Meanwhile,
<br />
<br />Attorney Frith cited State Statutes (15.1-437, Local Planning, and 15.1-456,
<br />
