<br />.. ~.~ <br /> <br />TUESDAY <br /> <br />JULY 8, 1975 <br /> <br />Supplementing a similar resolution adopted December 10, 1974, pertaining to the <br /> <br />''-'" <br /> <br />filing of an application for Federal financial assistance toward the construction <br /> <br />of required secondary sewage treatment facilities and to the developing and <br /> <br />maintaining by the City of Martinsville of a user charge system approved by <br /> <br />appropriate agencies, including the Federal Government's Environmental <br /> <br />Protection Agency, Council adopted the following resolution, being unanimous of <br /> <br />those members present but with reluctance on the part of Councilman Lester, who <br /> <br />expressed objection to the fact that the City, if it is to obtain Federal <br /> <br />assistance for this project, has no alternative but to accept and abide by <br /> <br />Federal restrictions and regulations, particularly--as in this case--the <br /> <br />regulation of sewerage service user charges by the City to its citizens and <br /> <br />customers: <br /> <br />WHEREAS, under date of December 10, 1974, pursuant to Public Law <br />92-500 and other applicable regulations, Martinsville City Council <br />resolved that--in connection with its desire to upgrade its <br />existing primary treatment facility to meet the goals and <br />objectives of said Public Law 92-500-a "Step 3 (construction <br />project)" grant application be filed with the Virginia Water <br />Control Board; and <br /> <br />WHEREAS, said resolution stipulated certain requirements of <br />present Federal laws applicable thereto, including the statement <br />(identified as item "3" of said resolution) that, if the present <br />user charge systems are not approved by the Environmental <br />Protection Agency, the City will develop and maintain a user <br />charge system subject to the review and approval of said agency; <br />and <br /> <br />WHEREAS, certain additional requirements have been subsequently <br />established, as incorporated in the following resolution, necessary <br />to review of said application and/or the making of a grant offer <br />by the appropriate governmental agencies; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this eighth day of July, 1975, that <br />said Council hereby agrees, as follows: <br />(a) To adopt a revised user charge system, if required, <br />within forty-five (45) days after submission for <br />adoption; and, <br />(b) To submit an adopted revised user charge system, if <br />revision is required, to the Environmental Protection <br />Agency with forty-five (45) days after adoption of <br />such revised user charge system. <br />
