<br />"'l ~..', <br /> <br />.1 j <br /> <br />TUESDAY <br /> <br />DECEMBER 23, 1980 <br /> <br />Council also unanimously accepted a grant of $3,380.00 from the State Health Department's <br /> <br />Division of Solid & Hazardous Waste Management, appropriating $1,460.00 thereof for replacement <br /> <br />of equipment and the balance of $1,920.00 for the purchase of waste containers, all within <br /> <br />the Refuse Collection-Disposal Section of the current City Budget. <br /> <br />Upon motion, duly seconded and unanimously carried, Council placed on first reading the <br /> <br />following ordinance rescinding that ordinance (identified as Amendment No. 12) amending <br /> <br />Section 11-18 of the City Code, as adopted October 14, 197s, inasmuch as the subsequently- <br /> <br />adopted BOCA Basic Fire Prevention Code (1978) provides that permits relating to fireworks can <br /> <br />be issued by the Fire Marshal: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular session held on December 23, 1980, that Section 11-18, as <br />amended, of the Code of the City of Martinsville, Virginia, be and the <br />same is hereby repealed and rescinded in its entirety. <br /> <br />Also upon motion, duly seconded and unanimously carried, Council adopted the following <br /> <br />ordinance designating the established Board of Appeals as the appellate body required by <br /> <br />Section F-la4.0 of the Fire Prevention Code: <br /> <br />WHEREAS, the City of Martinsville has previously adopted the BOCA <br />Basic Fire Prevention Code/1978 for all intents and purposes; and <br /> <br />WHEREAS, Section F-I04.0 of said Code provides for the creation <br />and maintenance of a five-member Board to handle appeals from any <br />person aggrieved by any decision or interpretation made by the <br />fire official under the provision of said Code; and <br /> <br />WHEREAS, Martinsville City Council has previously created a multi- <br />jurisdictional Board of Appeals of five persons to hear appeals <br />from administrative decisions made under other City codes and/or <br />ordinances; and <br /> <br />WHEREAS, said Council deems the established Board of Appeals to be <br />duly qualified to serve all the purposes described in Section F-I04.0 <br />of the Fire Prevention Code; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, <br />as follows: <br />
