<br />:1. r- 2 <br />"/ "j <br /> <br />TUESDAY <br /> <br />OCTOBER 14, 1980 <br /> <br />Open space consists of two types of land; public parks, used for <br />recreational purposes, and nature parks. Relatively large areas <br />are reserved for organized sports activities, play lots and other <br />outdoor activities. It is important to locate community facilities <br />such as football fields and tennis courts in a reasonable proximity <br />to the people they serve. Lands designated as nature parks consist <br />of vacant land which cannot economically be developed for other land <br />uses. They also serve as buffer areas between residential <br />developments. <br /> <br />OPEN SPACE-PUBLIC is publicly owned property and would generally <br />be developed into facilities for organized activities and natural <br />undisturbed areas used for community gatherings. <br /> <br />OPEN SPACE-PRIVATE would be those areas which would remain under <br />private ownership and would be left in their natural condition as <br />a buffer between residential neighborhoods and as a habitat for <br />various species of animals, until such time as an acceptable change <br />is approved by normal procedures. <br /> <br />These two categories as shown separately make up the open space <br />areas denoted on the proposed Land Use Map. <br /> <br />Appearing before Council on behalf of Lanier Farm, Inc., and in support of the <br /> <br />Planning Commission's recommendations as well as concurring with City Attorney <br /> <br />Worthy's opinion included in the Planning Commission's report, were Mr. Jackson C. <br /> <br />Dodge, President of Lanier Farm, Inc., and Mr. Benjamin R. Gardner, Attorney at Law <br /> <br />and Counsel for Lanier Farm, Inc. Appearing before Council on behalf of The Whittle <br /> <br />Family Trust, and in support of the Planning Commission's report and recommendations, <br /> <br />was Mr. Frank D. Fulton, Vice President & Trust Officer of The First National Bank <br /> <br />of Martinsville & Henry County, with Mr. Fulton informing Council that The Whittle <br /> <br />Family Trust has no plans for immediate development of its property but wishes to be <br /> <br />free-~ the Planning Commission's recommendations will permit--to develop its <br /> <br />property when and if it chooses. Mr. R. Stephens Pannill, of 1004 Mulberry Road, <br /> <br />speaking only for himself and his family interest, expressed concern with the <br /> <br />probability, as he envisions, that--should Council adopt the Planning Commission's <br /> <br />recommendations--individual property owners will have no recourse (except to seek, <br /> <br />as City Attorney Worthy stated, declatory judgments) and no opportunity to object <br /> <br />when and as property developers (i.e., Lanier Farm, Inc., and The Whittle Family <br /> <br />Trust) present their plans to the City and obtain the required permits.
