<br />n.'.2 <br />.j <br /> <br />TUESDAY <br /> <br />JANUARY 23, 1979 <br /> <br />(3) the possible devaluation of Scuffle Hill residential <br />properties; <br />(4) restriction of accessibility to Scuffle Hill; <br />(5) adverse change in the neighborhood character; and <br />(6) generation of pedestrian "trespassing". <br /> <br />In addition, Mr. Gregory claimed that the proposed development will not meet certain <br /> <br />City Code requirements, which petitioner pointed out were not applicable in this case. <br /> <br />In conclusion, Mr. Gregory asked of Council its consideration of both the numerous concerns <br /> <br />of the area property owners and the apparent technical "defects" pointed out. In response <br /> <br />to the traffic count "concern", Traffic & Planning Director Irving R. McGhee pointed out <br /> <br />that vehicular traffic emanating from the area's schools and industries are now using <br /> <br />the new Mulberry Extension route and, thus, traffic counts taken on any other occasion <br /> <br />would reflect little difference. Also, in response to a question concerning the boundary <br /> <br />line revision of the Central Business District, being proposed by the CBD Commission, <br /> <br />designed to encompass the proposed Leatherwood development, Council was informed that-- <br /> <br />although it has not officially approved the proposed revision--its adopted Land-Use Plan, <br /> <br />because it already includes the CBD's proposed revision, in effect gives tantamount <br /> <br />approval of the extended CBD proposal. After further discussion, a motion--duly <br /> <br />seconded--was introduced to accept the Planning Commission's recommendation (i.e., approve <br /> <br />petitioner's requests), following which, Attorney Gregory informed Council that, after <br /> <br />consultation with his clients present, objections by his clients to the proposed <br /> <br />development were forthwith withdrawn, noting that his clients in no way wish to alienate <br /> <br />themselves from possible good neighbors; whereupon, after commending these citizens for <br /> <br />their magnanimous gesture, Council unanimously adopted the motion introduced and, by so <br /> <br />doing, authorized the issuance of the requested Special-Use Permit (with stipulations <br /> <br />attached) and adopted the following ordinance amending the City's Zoning Map to reflect <br /> <br />the requested rezoning, meanwhile noting that a reported lack of adequate water pressure <br /> <br />in the area should be corrected by the City: <br />
