<br />n',2 <br />..... <br />,j <br /> <br />TUESDAY <br /> <br />JANUARY 9, 1979 <br /> <br />9-7.2 Second Step - If a satisfactory resolution is not reached <br />at the first step, the employee may so indicate on the grievance <br />form and submit the grievance to the next level of supervision <br />within ten (10) working days. A meeting to review the grievance <br />shall be held between the employee and the concerned Division <br />Head or the Department Head if the Department has no Division setup, <br />within five (5) working days. The time limit between the second <br />step submission and the second step meeting may be extended by <br />mutual agreement. If more than two levels of supervision exist <br />between the grievant and his Division Head, such levels of <br />supervision may also attend this meeting if so requested by the <br />Division Head or grievant. <br /> <br />At the second step meeting, the employee may have legal counsel <br />or a fellow employee of his/her choice present. The second step <br />supervisor may likewise have legal counselor a witness present <br />if he/she so desires. A second step written reply to the grievance <br />shall be provided to the employee within five (5) work days after <br />the second step meeting. A copy of the grievant's statement and <br />the second step supervisor's response shall be given to the <br />concerned Department Head. <br /> <br />9-7.3 Third Step - If a satisfactory resolution is not reached <br />at the second step, the employee may submit the grievance to the <br />Department Head. Submission to the third step must occur within <br />ten (10) working days of the second step reply. The Department <br />Head will meet with the employee within five (5) working days or <br />indicate an extension is necessary. Such extension shall not <br />exceed three (3) additional work days except by mutual agreement. <br />The employee may have legal counselor a fellow employee of his/her <br />choice present at the third step meeting. The Department Head may <br />have legal counselor a witness of its choice likewise in attendance. <br />The Department Head shall render a written reply to the grievance <br />within five (5) working days following the third step meeting. <br /> <br />9-7.4 Fourth Step - If a satisfactory resolution is not reached <br />at the third step, the employee may submit the grievance to the <br />City Manager. Submission to the fourth step must occur within <br />ten (10) working days of the third step reply. The City Manager <br />and Assistant City Manager will meet with the employee within five <br />(5) working days or indicate an extension is necessary. Such <br />extension shall not exceed three (3) additional work days except <br />by mutual agreement. The employee may have legal counselor a <br />fellow employee of his/her choice present at the fourth step <br />meeting. The City Manager may have legal counselor a witness of <br />his choice likewise in attendance. All participants in the previous <br />steps may attend the fourth step meeting. The City Manager shall <br />render a written reply to the grievance within five (5) working days <br />following the fourth step meeting. <br />
