<br />(. <br /> <br />..li ) <br /> <br />TUESDAY <br /> <br />JANUARY 9, 1979 <br /> <br />Where extenuating circumstances or uncontrollable conditions prohibit <br />either the grievant or respondent from complying with a particular <br />procedure within the stated period of time, a reasonable delay in the <br />proceedings shall be allowed without the agreement of the other party. <br />The City Manager shall determine whether there is substantial reason <br />for the delay and if so, what shall be considered a reasonable <br />extension of time. This provision shall apply in any instance in <br />which the two parties cannot reach mutual agreement on a substanial <br />procedural requirement. <br /> <br />Employees of the City who wish to file a grievance must follow the <br />step-by-step procedure as hereinafter specified, except as follows: <br /> <br />-- <br /> <br />a. An employee whose immediate supervisory level is <br />above that which is set forth in Step I, and below <br />the supervisory level as set forth in Step IV, shall <br />initiate his/her grievance with his/her next level <br />of supervision using the appropriate step level <br />fitting his/her particular situation. The initial <br />procedure for filing such a grievance shall be set <br />forth in that step. <br /> <br />b. Departments and offices which do not have the number <br />of levels or supervision paralleling the supervisory <br />levels as set forth in the steps of this grievance <br />procedure, may omit nonapplicable intermediate steps, <br />provided, however, the initial procedure for filing <br />a grievance shall conform to the requirements of the <br />step in which the employee initiates the grievance. <br /> <br />Sec. 9-7 Procedure <br /> <br />- <br /> <br />9-7.1 First Step - Within thirty (30) days after the occurence <br />or condition glvlng rise to the grievance, the employee affected <br />may identify the grievance verbally to the employee's immediate <br />supervisor. Within five (5) working days of such presentation, <br />the supervisor shall give his/her response to the employee with <br />respect to the grievance, or shall advise the employee that <br />additional time for such decision is needed, in which case a <br />decision must be given the employee within three (3) working days <br />thereafter. <br /> <br />If a satisfactory resolution is not reached by this process, the <br />employee shall reduce the grievance to writing, identifying the <br />nature of the grievance and the expected remedy on the grievance <br />form. Such written grievance shall be presented to the immediate <br />supervisor within five (5) working days of the immediate supervisor's <br />verbal reply. The immediate supervisor must then reply in writing <br />within five (5) working days. <br />
