<br />-)~ <br /> <br />TUESD-AY <br />. <br /> <br />DECEMBER 12, 1978 <br /> <br />"- <br /> <br />Council (and its members) acknowledged receipt of an official notice that the County <br /> <br />of Henry and/or its Board of Supervisors has duly filed, with the appropriate court <br /> <br />of jurisdiction~ a Petition for Declaratory Judgment to obtain a judicial decision as <br /> <br />to whether the City of Martinsville has the right to provide water service, as it <br /> <br />officially agreed to do (by Council's action on November 28, 1978), to a facility being <br /> <br />constructed by Frith Construction Company in--or adjoining--the City's Industrial Park~ <br /> <br />- <br /> <br />outside of the City. Council was informed~ too, that petitioner has obtained a <br /> <br />temporary injunction in this case which prohibits the City's installing a water <br /> <br />connection for this facility and/or providing water service thereto, Meanwhile~ City <br /> <br />Attorney Worthy informed the Council that~ in his opinion~ under State statutes (before <br /> <br />their last being amended) and on the basis of court decisions in like cases and because <br /> <br />the City has provided water service to the Industrial Park area and because the Henry <br /> <br />County Public Service Authority has only recently installed its water lines in the <br /> <br />vicinity of the Industrial Park, the City's November 28th action should be sustained <br /> <br />and confirmed. Upon motion, duly seconded and unanimously carried~ Council authorized <br /> <br />and directed the City Attorney to file a responsive pleading for and on behalf of the <br /> <br />City. <br /> <br />- <br /> <br />Policies and procedures in the handling of problems~ such as reportedly developed <br /> <br />recently in the Kenmar Dirve-Meadowview Lane area, involving the presence of rodents~ <br /> <br />were described for Council~ with Councilman Oakes suggesting that some improvement in <br /> <br />the City's response to various types of complaints is desirable, <br /> <br />Council was adjourned, <br /> <br />~. <br /> <br /> <br />of Council <br />
