<br />TUESDAY <br /> <br />AUGUST 22, 1978 <br /> <br />Also, pursuant to duly-advertised public notice, Council conducted a public hearing on <br /> <br />Mrs. Margaret S. Hearn's petition seeking the rezoning of her property at 208 Starling <br /> <br />Avenue from "R-6 Residential" to "P-2 Professional", as filed through her attorney, <br /> <br />Mr. Benjamin R. Gardner, with Council on June 13, 1978. The Planning Commission having <br /> <br />processed this petition and having recommended same for approval, and there being no <br /> <br />objections registered by any citizen to the proposed rezoning, Council unanimously adopted <br /> <br />the following ordinance effecting the requested rezoning and amending the City's Zoning <br /> <br />,/ <br /> <br />Map accordingly: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this twenty-second day of August, 1978, <br />that the Zoning Map of the City of Martinsville, Virginia, be--and <br />is hereby--amended to effect and reflect a "P-2 Professional" zoning <br />of that property identified as owned by Mrs. Margaret S. Hearn and <br />situated on the west side of Starling Avenue and as being located at <br />208 Starling Avenue. <br /> <br />Pursuant to duly-advertised public notice, Council conducted a public hearing on Mr. Donald <br /> <br />C. Custer's amended application (see Council minutes of meeting held April 25, 1978) for a <br /> <br />Special-Use Permit which, if granted, would allow Mr. Custer to construct twelve apartment <br /> <br />units (in addition to his existing five units) on property located at the corner of Spruce <br /> <br />Street and Berkshire Place, should he obtain the Planning Commission's approval of a <br /> <br />resubdivision of said property by combining Lots Nos. 25 and 26 with Lot No. 27. At the <br /> <br />outset of this public hearing, Council reviewed the Planning Commission's report on this <br /> <br />matter, dated July 21, 1978, in which report the Commission recommended that Council not <br /> <br />approve Mr. Custer's application. Said report was as follows: <br /> <br />The Planning Commission conducted a Public Hearing on Thursday, July 20, <br />with regard to a petition submitted by Mr. Donald C. Custer requesting a <br />Special Use Permit which would allow him to construct an additional twelve <br />units of apartments making a total of seventeen units on the property <br />lying at the corner of Spruce Street and Berkshire Place. <br /> <br />During this Public Hearing many of the residents of Berkshire Place and <br />several on Spruce Street in close proximity to property in question <br />appeared before the Commission objecting to the construction of additional <br />apartments on this property on the grounds that traffic would increase in <br />
