M Martinsville A CITY WITHOUT LIMITS October 20, 2006 The Honorable Mayor and City Council City of Martinsville Martinsville, Virginia Dear Council Members: The Planning Commission, at its regular meeting of October 19, 2006, conducted a duly advertised public hearing on a request by Earl Lawrence on behalf of the H. M. Talburt Trust, to rezone 707, 709, 711 Fayette Street and 100 Sellers Street, known on the Tax Map of the City of Martinsville, as 31(2)HIl7R, 17S, 3R, 18, from R-6 Residential to C-3 Commercial. ' At the Public Hearing it was noted this comer property is situated at the intersection of two high traffic streets (Memorial Boulevard and Fayette Street). It is surrounded by commercially designated properties on the north, east and west, with residential to the southwest on Sellers Street and the south side of Fayette Street. The parcels contain a total of approximately 56,509 square feet. The owner is asking for a C-3 Commercial zoning classification which will coincide with the existing zoning and allow him to market the property for its highest and best use. This property is already designated for Commercial usage on the Proposed Land Use Map. A number of residents from the surrounding neighborhood spoke at the public hearing. There was some opposition to any rezoning, as well as those not opposed to the rezoning as long as any potential use would not negatively impact the community and City. In order to assure compliance with Virginia Code 15.2-2200, it is stated that the public purpose for which these Resolutions are initiated is to promote the public health, safety or general welfare of its citizens and to plan for the future development of the community.
