<br />TUESDAY <br /> <br />NOVEMBER 23, 1982 <br /> <br />privileges and obligations herein contained by or on behalf of the City <br />or Company shall bind and inure to the benefit of their respective <br />successors. <br /> <br />SECTION 302. Corporate Limits of City. Notwithstanding anything <br />herein to the contrary, this Franchise Ordinance shall apply only within <br />the corporate limits of the City as constituted on the effective date of <br />this ordinance and not to any areas which may subsequently become a part <br />of the City by any annexation proceedings or by merger or consolidation <br />with other governmental bodies. <br /> <br />SECTION 303. Prior Agreements. This Franchise Ordinance supercedes <br />any franchise rights granted to the Company in all prior Franchise <br />Ordinances or similar agreements between the City and the Company. <br /> <br />SF.r,TION 304. Franchise Term. The franchise herein granted shall <br />take effect and be in force from and after the final passage hereof, as <br />required by law, and upon the filing of acceptance by the Company with <br />the office of the Mayor, and shall continue in force and effect for an <br />initial term of ten years from the effective date of this Franchise <br />Ordinance, and it shall be automatically renewed for successive terms of <br />five years each unless either party gives the other party written notice <br />of its intention not to renew the franchise at least six months prior to <br />the end of the then current term. This Franchise Ordinance shall be <br />accepted by the Company within sixty (60) days from the date of the <br />passage of the same or the provisions of this Franchise Ordinance shall <br />be null and void. <br /> <br />This ordinance shall be in full force and effect ten (10) days <br />after its final passage. <br /> <br />Upon recommendation jointly by City Manager Edmonds and Commissioner of the Revenue <br /> <br />J. Ronnie Minter, Council accepted for introduction a proposed ordinance which, if <br /> <br />-- <br /> <br />adopted, will replace the City's current Business License Tax Ordinance to comply with <br /> <br />the provisions of Chapter 7 of Title 58 of the CODE OF VIRGINIA (1950, and as amended), <br /> <br />effective January 1, 1983, under which provisions the Virginia General Assembly, among <br /> <br />other things, has categorized or classified--for business tax purposes--business and <br /> <br />professional occupations and has established maximum tax rates any local government may <br /> <br />impose on each classification, the effect of which, in the case of the City of <br /> <br />Martinsville, will require a roll-back in certain rates and thereby reduce the City's <br /> <br />revenue from this source.
