TUESDAY NOVEMBER 23, 1982 privileges and obligations herein contained by or on behalf of the City or Company shall bind and inure to the benefit of their respective successors. SECTION 302. Corporate Limits of City. Notwithstanding anything herein to the contrary, this Franchise Ordinance shall apply only within the corporate limits of the City as constituted on the effective date of this ordinance and not to any areas which may subsequently become a part of the City by any annexation proceedings or by merger or consolidation with other governmental bodies. SECTION 303. Prior Agreements. This Franchise Ordinance supercedes any franchise rights granted to the Company in all prior Franchise Ordinances or similar agreements between the City and the Company. SF.r,TION 304. Franchise Term. The franchise herein granted shall take effect and be in force from and after the final passage hereof, as required by law, and upon the filing of acceptance by the Company with the office of the Mayor, and shall continue in force and effect for an initial term of ten years from the effective date of this Franchise Ordinance, and it shall be automatically renewed for successive terms of five years each unless either party gives the other party written notice of its intention not to renew the franchise at least six months prior to the end of the then current term. This Franchise Ordinance shall be accepted by the Company within sixty (60) days from the date of the passage of the same or the provisions of this Franchise Ordinance shall be null and void. This ordinance shall be in full force and effect ten (10) days after its final passage. Upon recommendation jointly by City Manager Edmonds and Commissioner of the Revenue J. Ronnie Minter, Council accepted for introduction a proposed ordinance which, if -- adopted, will replace the City's current Business License Tax Ordinance to comply with the provisions of Chapter 7 of Title 58 of the CODE OF VIRGINIA (1950, and as amended), effective January 1, 1983, under which provisions the Virginia General Assembly, among other things, has categorized or classified--for business tax purposes--business and professional occupations and has established maximum tax rates any local government may impose on each classification, the effect of which, in the case of the City of Martinsville, will require a roll-back in certain rates and thereby reduce the City's revenue from this source.
