<br />TUESDAY <br /> <br />OCTOBER 26, 1982 <br /> <br />Pursuant to Section 2.1-344(a)(2) and Section 2.1-344(a)(6) of the CODE OF VIRGINIA (1950, <br /> <br />and as amended), and upon motion (duly seconded and unanimously carried by a recorded vote), <br /> <br />Council convened into an Executive Session to (1) discuss the possible acquisition of certain <br /> <br />real property for public purposes and (2) to confer or consult with legal counsel on certain <br /> <br />legal matters within the Council's jurisdiction. Upon reconvening into regular session, <br /> <br />Council took no action with regard to the possible acquisition of certain real property; <br /> <br />- <br /> <br />however, with regard to legal matters discussed, and upon motion (duly seconded and unani- <br /> <br />mously carried), Council agreed in principle with a proposal by which Appalachian Power <br /> <br />Company will sell and transfer its facilities in the Forest Park area to the City (in order <br /> <br />that the City provide electric service to some ninety residential customers in that area, <br /> <br />which was annexed to the City as of January 1, 1965) for the sum of $60,699.00, plus an <br /> <br />additional charge for crew-and-equipment time in effecting the transfer of these facilities. <br /> <br />Council also unanimously authorized the preparation of documents by which, after completing <br /> <br />the course of required legal procedures, Appalachian Power Company might obtain a franchise <br /> <br />to serve six industrial customers within the City (having served these customers for many <br /> <br />years under terms of the City's wholesale power purchase agreements with Appalachian) as <br /> <br />well as to transfer from the present agreement and/or provide necessary r-o-w easements to <br /> <br />Appalachian for its power lines and substations within the City. <br /> <br />The meeting was declared adjourned. <br /> <br /> <br />y--;; <br />Clerk of Council <br />
