<br />TUESDAY <br /> <br />OCTOBER 12, 1982 <br /> <br />Upon motion, duly seconded and unanimously carried by a recorded vote, and pursuant to <br /> <br />Section 2.1-344(a)(6) of the CODE OF VIRGINIA (1950, and as amended), Council convened <br /> <br />into an Executive Session for the purpose of considering (with legal counsel and con- <br /> <br />sultants) certain legal matters within the Council's jurisdiction. Upon reconvening into <br /> <br />regular session, Council reported that the Ridgeway Hydroelectric Project license appli- <br /> <br />cation, filed in March of 1982 with the Federal Energy Regulatory Commission, has been <br /> <br />- <br /> <br />determined by said Commission as being deficient in that certain detailed studies and <br /> <br />findings heretofore required by the Commission in later down-the-road processes are now <br /> <br />required by the Commission, as a result of recently-changed Commission procedural rules, <br /> <br />to be a part of the formal license application filing and (that) the cost of conducting <br /> <br />such studies by the City's consulting engineering firm of R. W. Beck & Associates must be <br /> <br />shifted to the current III-A phase of the project (from the succeeding or subsequent III-B <br /> <br />phase) and the work must be authorizeG if the license application is to be revised and <br /> <br />re-submitted by November 30, 1982, or before the two-year preliminary permit expires, to <br /> <br />avoid further delay in t}Je project schedule. Accordingly, upon motion (duly seconded and <br /> <br />unanimously carried), Ccuncil appropriated the additional sum of $50,000.00 (i.e., in <br /> <br />addition to that currently budgeted) to finance the cost of the now-required studies to be <br /> <br />included in a re-submitted license application, thereby amending the City's Phase III-A <br /> <br />-, <br /> <br />contract with R. W. Beck & Associates. <br /> <br />The meeting was then declared concluded and adjourned. <br /> <br />~.- <br />W. H. Y ~:~a Clerk of Counci 1 <br />
