<br />TUESDAY <br /> <br />SEPTEMBER 14, 1982 <br /> <br />WHEREAS, said ordinance did not adequately define "fire districts" <br />within the City; and <br /> <br />WHEREAS, the penalty provisions in said ordinance have been <br />found to be inconsistent and in conflict with applicable provisions <br />of the State Code, Sec. 36-106; <br /> <br />NOW THEREFORE, BE IT ORDAINED by the City Council of the <br />City of Martinsville, Virginia, in regular session held on the 14th <br />day of September, 1982, that: <br /> <br />1. A new Article VII, entitled "Fire Districts", shall <br />be incorporated in said ordinance to read as follows: <br /> <br />Sec. 7.1 Defined <br /> <br />For all purposes in enforcement of the USBC, land <br />within the City which, in accordance with the zoning <br />ordinance, is zoned for business, commercial or <br />industrial uses is established a5 a fire district. <br /> <br />2. Article VII in said ordinance shall be renumbered as <br />Article VIII, entitled "Violations and Penalties" and <br />shall read as follows: <br /> <br />Sec. 8.1 Separate Offenses <br /> <br />Any person who shall refuse, fail, or neglect to comply <br />with the provisions of this ordinance or with any of the <br />requirements thereof shall, unless otherwise provided, <br />be guilty of a separate offense for each and every day, <br />or portion thereof, during which any violation of any of <br />the provisions of this ordinance is committed, continued <br />or permitted, and upon conviction of any violation of any <br />of the provisions of the ordinance, such person shall be <br />punished for a fine of not more than one thousand dollars. <br /> <br />Sec. 8.2 Outside the City Boundaries <br /> <br />As either an additional or a specific penalty for violation <br />of the requirements of the Code, where the violation <br />occurs beyond the corporate boundaries of the City, the <br />City may deny or discontinue municipal water and/or <br />sewer service to a property upon determining that a <br />violation to the ordinance has or is occuring. <br /> <br />3. Article VIII in said ordinance shall be renumbered as <br />Article IX, entitled "Validity and Separability", with <br />the wording therein unchanged. <br /> <br />BE IT FURTHER ORDAINED, that the additions and corrections provided for herein <br />are considered to be emergency matters, that the requirement for a separate-day <br />introduction of this ordinance is hereby waived, and that this ordinance shall <br />become effective immediately upon its adoption. <br />
