<br />AUGUST 24, 1982 <br /> <br />TUESDAY <br /> <br />paper, or cardboard originating or situated on the pre- <br />mises or private residences may be burned. <br /> <br />b. Unless all material burned is fully contained within a <br />box or cage of metal or other non-combustible material <br />or consists only of leaves, weeds, grass, or shrubbery <br />clippings in a pile less than five feet in diameter and <br />less than three feet in height, prior approval for the <br />burning must be obtained from the fire chief or an on- <br />duty fire department officer. <br /> <br />c. All burning must be done between 9:00 A.M. and 5:00 P.M. <br />with all embers completely extinguished by 5:00 P.M., <br />and no material may be added to the fire after 3:00 P.M. <br /> <br />d. All burning must be located not less than fifty (50) feet <br />from any occupied building unless the occupant of the <br />building has given prior permission for burning closer to <br />his property. <br /> <br />e. All outdoor fires shall be attended at all times. <br /> <br />f. No person shall allow an outdoor fire to spread to the <br />lands or property of another or allow such fire to <br />jeopardize any building, machinery, or vehicle. <br /> <br />g. If any officer of the city fire department finds that a <br />person engaged in outdoor burning is contributing to <br />air pollution and that such pollution creates an emer- <br />gency which requires immediate action to protect the <br />public health or safety, or that a person engaged in <br />outdoor burning is violating one or more conditions <br />of this section or is creating a fire hazard requiring <br />immediate action to protect the public health or safety, <br />such officer shall order the immediate extinguishment <br />of such fire and the immediate discontinuance of such <br />burning. It shall be unlawful to refuse to obey such <br />an emergency order. <br /> <br />h. The provisions of this section shall not apply to outdoor <br />cooking with charcoal, provided such charcoal is fully <br />contained within a grill or fireplace of metal, brick, <br />stone or other non-combustible material and such grill <br />or fireplace is at least three feet from any combustible <br />ma t e ria 1 . <br /> <br />- <br /> <br />i. Nothing in this section shall be construed as to be in <br />conflict with applicable rules and regulations adopted by <br />the State Air Pollution Control Board pursuant to Sections <br />10-17.10 through 10-17.30 of the Code of Virginia (1950). <br /> <br />j. Any violation of this section shall constitute a Class 1 <br />misdemeanor. <br />
