<br />TUESDAY <br /> <br />AUGUST 24, 1982 <br /> <br />The regular semi-monthly meeting of the Council of the City of Martinsvil1e, Virginia, <br /> <br />with Mayor William C. Cole, Jr., presiding, was held Tuesday, August 24, 1982, in the <br /> <br />Council Chamber, City Hall, beginning at 7:30 P.M., all members being present, as follows: <br /> <br />William C. Cole, Jr., Mayor; L. D. Oakes, Vice-Mayor; Henry C. Reed; Mrs. Eliza H. Severt; <br /> <br />and Francis T. West. <br /> <br />After the invocation, Council approved--as recorded--the minutes of its regular meeting <br /> <br />held August 10, 1982, with the concurrence by City Attorney David B. Worthy as to his <br /> <br />legal advice recorded during the August 10th public hearing on the Patrick Henry Mental <br /> <br />Health Center's petition seeking the rezoning to "P-2" of the Paul S. Davis property at <br /> <br />301 Starling Avenue, which advice he subsequently elaborated on during further consider- <br /> <br />ation of this matter by Council in the meeting covered by these (August 24th) minutes. <br /> <br />And, in giving further consideration to the Patrick Henry Mental Health Center's rezoning <br /> <br />petition, referred to hereinabove, Council acknowledged receipt from City Manager <br /> <br />Edmonds a written report and commentary consisting of a review of this case in general <br /> <br />and, in addition, an identification of alternatives available to Council. Also presented <br /> <br />was the Planning Commission's report and recommendation that the petition be approved, <br /> <br />noting that the proposed usage by petitioner of the property is permissible under the <br /> <br />City's P-2 zoning regulations. Meanwhile, Mr. John W. Swezey, Attorney at Law and <br /> <br />Counsel for adjacent property owners, informed Council that--after further consultation <br /> <br />with his clients (Mr. W. T. Turner, et ai, and Dr. Norman Warren) and with other interested <br /> <br />parties--his clients are withdrawing their objection raised at the August 10th meeting <br /> <br />concerning the P-2 classification proposed for the property in question (i.e., the Paul S. <br /> <br />Davis property at 301 Starling Avenue) but still have questions and reservations, and <br /> <br />may be considering recourses, as to the usage of the property proposed by petitioner. <br />
