<br />TUESDAY <br /> <br />AUGUST 10, 1982 <br /> <br />WHEREAS, Section 58-847 of the CODE OF VIRGINIA (1950, and as amended) <br />authorizes the governing body of any city to provide by ordinance the <br />time for filing annual returns of taxable tangible personal property <br />and to provide by ordinance the penalties for the failure to file such <br />returns on time; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />that, beginning in 1983 and continuing each succeeding year thereafter, <br />the annual returns of taxable tangible personal property shall be <br />filed with the office of the City's Commissioner of the Revenue on or <br />before May 1st; and <br /> <br />- <br /> <br />BE IT FURTHER ORDAINED that the penalty for failure to file any such <br />return on or before said May 1st of each year shall be ten percent <br />(10%) of the tax assessable on such return or ten dollars ($10.00), <br />whichever is greater, and that said penalty shall be assessed on the <br />day after any such return is due; and <br /> <br />BE IT FURTHER ORDAINED that the Commissioner of the Revenue be, and he <br />hereby is, authorized to grant reasonable extensions of time, not to <br />exceed ninety (90) days, for filing any such return whenever good cause <br />exists; provided, that if any taxpayer who has been granted an extension <br />of time for filing his return fails to file said return within the <br />extended time his case shall be treated the same as if no extension had <br />been granted. <br /> <br />Council also unanimously adopted the following ordinance (introduced July 27, 1982) <br /> <br />which provides for the mandated repair and/or condemnation and mandated removal of <br /> <br />unsafe buildings within the City: <br /> <br />WHEREAS, the Virginia Uniform Statewide Building Code (USBC) provides <br />for condemnation and mandated removal or demolition of unsafe buildings <br />within a City; and <br /> <br />WHEREAS, Section 15.1-11.2 of the Code of Virginia provides that the <br />work of repair or demolition of unsafe buildings may proceed by order <br />of the Building Official, with the cost thereof to be levied against <br />the owners of such buildings; now therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsvil1e, in regular <br />session held on the 10th day of August, 1982, as follows: <br /> <br />1. Right of condemnation: Buildings and their equipment <br />constructed after September 1, 1973, and subject to <br />the USBC when constructed that fail to comply with the <br />USBC through deterioration, improper maintenance, or <br />for other reasons, and thereby become unsafe, unsani- <br />tary, or deficient in adequate exit facilities, and <br />which constitute a fire hazard, or are otherwise danger- <br />ous to human life or the public welfare, shall be <br />deemed unsafe buildings. All unsafe buildings shall be <br />made safe through compliance with the USBC or shall be <br />taken down and removed, as the Building Official may deem <br />
