<br />,d\ <br /> <br />,) <br />~:_..,j <br /> <br />TUESDAY <br /> <br />AUGUST 10, 1982 <br /> <br />which period petitioner might locate another site (which petitioner indicated it would <br /> <br />not voluntarily seek), City Attorney Worthy pointed out that, with "P-2" zoning already <br /> <br />in effect for surrounding properties, Council has no choice but to grant petitioner's <br /> <br />rezoning request, unless Council wishes to risk possible litigation, inasmuch as Council <br /> <br />can not legally deny the request solely on petitioner's proposed usage. City Manager <br /> <br />Edmonds pointed out, too, that the proposed usage has been declared, both by the Planning <br /> <br />Commission and the City's Building Official, allowable under the City's "P-2" zoning <br /> <br />regulations. Councilman Reed then moved that this matter be placed on Council's next <br /> <br />meeting's agenda; however, this motion was not seconded. No actions having been taken <br /> <br />by Council on Councilman West's motions because of continuing discussions, Councilman <br /> <br />West then introduced a motion (which was duly seconded) that his prior motion(s) be <br /> <br />withdrawn and (that) Council delay action on the request for a period of up to thirty <br /> <br />(30) days, leaving to City Manager Edmonds' discretion as to when during this interim <br /> <br />period to bring the matter (i.e., place on the agenda) back to Council for further con- <br /> <br />sideration and/or action. The motion carried unanimously. <br /> <br />After conducting its 1982 (annual) review of the Martinsville Exchange Club's Specia1- <br /> <br />Use Permit (initially issued February 12, 1980 for the years 1980 through 1984), in <br /> <br />preparation by the Exchange Club of its 1982 sponsorship of the Henry County Fair during <br /> <br />the period September 6th-September 11th, Council unanimously continued this permit in <br /> <br />force for the 1982 Fair, subject to the conditions attached thereto when first issued. <br /> <br />Council unanimously adopted the following ordinance (as introduced July 27, 1982) which <br /> <br />provides for the filing of taxable tangible personal property returns with the City's <br /> <br />Commissioner of the Revenue and (for) penalties for failure to file such returns on or <br /> <br />before the herein-established due date: <br />
