<br />, <br />hi cCc-t <br /> <br />-- <br /> <br />-- <br /> <br />TUESDAY <br /> <br />APRIL 13, 1982 <br /> <br />Upon recommendation of City Manager Edmonds, Council unanimously authorized the termination <br />of a contract with the Henry County Public Service Authority, under which contract the City <br />purchased emergency water supply from the PSA for the City's Industrial Park water <br />customers, it being deemed that the City's recent water emergency conditions no longer <br />exist. <br /> <br />Pursuant to the requirements of the Virginia Department of Highways and Transportation, <br /> <br />Council unanimously adopted the following resolution under which the City assumes the <br /> <br />responsibility for the adjustment and/or relocation of certain utilities and for the <br /> <br />installation of certain new facilities in connection with the proposed highway project <br /> <br />cited therein: <br /> <br />WHEREAS, the Virginia Department of Highways & Transportation proposes to <br />construct or otherwise improve a section of roadway from 0.47 miles east of <br />Hunting Ridge Road to 0.15 miles east of Hunting Ridge Road, designated as <br />Highway Project 0650-120-101, RW202, C502; and <br /> <br />WHEREAS, the Council of the City of Martinsville, Virginia, is responsible for <br />making arrangements for the adjustment and/or relocation of certain utilities <br />and for the installation of any new facilities; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in regular <br />meeting assembled this 13th day of April, 1982, that it hereby certifies that <br />all arrangements have been made or will be made for the relocation and/or adjustment <br />of said utility facilities and for the installation of any new facilities; and, <br />further, in the event of any justifiable claims from the road contractor for <br />delays or interference caused by said utilities, the City of Martinsville hereby <br />agrees to be responsible for said claims, provided it may legally do so and <br />further provided that the City of Martinsville is advised in writing by the <br />Virginia Department of Highways & Transportation at the time of delay that the <br />road contractor intends to file a claim. <br /> <br />Said utilities are identified as follows: <br /> <br />UTILITY OWNERS <br /> <br />TYPE OF FACILITY <br /> <br />City of Martinsville, Virginia <br />Central Telephone Co. of Virginia <br />Appalachian Power Company <br /> <br />Electrical and Sewer <br />Communication <br />Electrical <br /> <br />Council acknowledged receipt of a petition, filed by twenty-one of twenty-two owners of <br />property alongside Mornighside Drive, requesting the construction of curb-and-gutter <br />along this street under the City's shared-cost construction policy. <br /> <br />--- <br /> <br />-- <br />
