:j ()

TUESDAY

MARCH 9, 1982

Also, upon motion (duly seconded and unanimously carried), Council approved--for City

Manager Edmonds' execution on behalf of the City--an agreement with the Norfolk

Southern Railway Company, whereby the City will be permitted to construct (at Norfolk

Southern's expense) and maintain (at the City's expense) a six-inch sewer line upon

Norfolk Southern's right-of-way for the purpose of providing sewer service to Norfolk

Southern's depot facility at or near Fisher Street.

Upon motion, duly seconded and unanimously carried, Council accepted a perpetual

easement from Lanier Farm, Inc., which permits the continued public use of a roadway

(thirty-four feet in r-o-w width) across Lake Lanier Dam and connecting the end of

the existing right-of-way of Corn Tassel Trail on the east side of Lake Lanier to the

end of the existing right-of-way of Corn Tassel Trail on the west side of Lake Lanier,

which roadway the City will maintain but will assume no responsibility or obligation

for maintenance of Lake Lanier Dam, its spillway structures, or any other facilities

owned by Lanier Farm and located within the limits of the easement or adjacent thereto.

Council unanimously accepted City Manager Edmonds' proposal that certain City-owned

tracts of land, deemed as being surplus properties and details of which were previously

presented to Council, be offered for sale by the advertising thereof and the inviting

of bids therefor on a scheduled basis, with Council reserving the right to reject any

and/or all bids.

Upon recommendation of City Attorney Worthy, Council directed that previously-authorized

procedures to enforce collection from Sidney's Properties, Inc., of that property owner's

share of the cost of recent improvements made through the City's Streetscape Project be

held in abeyance, noting that this matter might be resolved within the next two weeks.
