". .

TUESDAY

SEPTEMBER 29, 1981

Pursuant to Section 2.1-344(a)(6) of the CODE OF VIRGINIA (1950, and as amended), and
upon motion, duly seconded and carried unanimously by a recorded vote, Council convened
into an Executive Session for the purpose of being briefed by City Attorney Worthy on
certain legal matters. Upon reconveneing into regular session, Council made public the
fact that a number of residents living in the Forest Park area (annexed to the City as
of January 1, 1965, on petition of those residents), being served with electric service
by Appalachian Power Company, now desire to be served by the City's electric utility
system; and, inasmuch as APCo has expressed itself as being unwilling to sell its
electric facilities in that area to the City, Council unanimously authorized the
preparation of certain analytical data, for report back to Council by the end of 1981,
which could become a part of the basis for instituting condemnation proceedings against
APCo to acquire said facilities and to begin, if successful in such proceedings,
serving these residents.

Council was adjourned.

l~~~-,4.;'~'\-l_~ '-u.-. __:-
W.
